    hi,
Capital One didnt charge me for my staements as they only sent me copies of my statemts not actuals..
so they shouldnt cash your cheque..
They sent my staements through fairly quickly after sending me a letter stating it would take them 8 weeks to send them..the next day they arrived...

forgot to say they dont return your cheque though..
and its costs £7.50 from my bank to get a cheque stopped..maybe another massive over charge..!
so have chosen not to get my cheque stopped..

Are Capital One of the complaines that do cash your £10 cheque that you send with your 1st letter?
Ive claimed back from 2 banks now but both have always sent my statements free of charge. Do Capital one send you back the cheque uncashed.
I dont think ive ever been charged by them hence am wondering if I cgance the £10

When I sent my letters off to Capital One I didn't enclose a cheque - I chose to wait and see if they asked for it and they never ;)

I didnt send a cheque as everything I'd seen on here said they didnt charge for the service. However, I didnt receive statements just a letter today with a list of charges albeit giving dates.

Just did a quick phone call to see if they want to do this the easy way and settle now and the idiot I spoke to told me I had failed the security questions since I couldnt provide a mobile telephone number. I countered with it wasnt relevant as we no longer have a card with them and did not have mobile phones at the time. Embarrassed silence from him and a recommendation to write in. (Preferable anyway for me ) so my printer is now locked and loaded for battle :)

good luck to all in claiming :)

edit: On checking the letter with the list of charges they are incomplete. I have proof of three charges on old statements that they have not included. Letter gone off stating deliberate concealment ... not impressed at all. Others receiving data in this way from them beware and demand copy statements at no charge if they cannot provide complete information any other way.

i had the usual letter back from C.ONE stating charged were fair ..blah..blah..blah..
but they would send me a cheque for £64-(the difference between the £12-20 charge)
My partner also got the same..but he got his £64 refunded onto his card straight away where as i would be recieving a cheque for this amount as my account was clear..
i still wrote off accepting this money without predjudice but persuing the rest of the money..inc intretest...
But no cheque for £64 has appeared yet...
do I just wait for the 7 days to reply to my letter to elapse or do i ring them now for my cheque and chase up the rest of the m oney whilst im there..?

Did you actually have to take them to court before they paid up? I'm quite nervous about having to go that far, even though loads of others have ...

I was the same but there is really nothing to worry about.

I filled my claim in on MCOL. They acknowledge the claim which made me really nervous but then I got a cheque in the post about a week later.

They just wait and see if people will get scared and stop the claim but don't. If you just stick to Martin's step by step guide you can't go wrong.

Good luck and don't worry ;)

    calendar days

After sending 2nd letter off- recieved letter today... which included the below...

As explained , we a re confident our fees are both fair and legal and im disapointed you are considering court action...the oft havent told us that we're oblidged to refund any fees, i am not prepared to refund all the fees weve added as you asked...
Financial regulations require me to advise you this is my final response in relation to this matter, however you have the option to contact the financial ombudsman....

    advice ?

They have probably withdrawn the offer because you are wanting full settlement and not informed you. When the 7 days is up carry on with the reclaiming process and persist for all your money back.

    Good luck :)

    Hi,
I haven't read through the whole thread, cause its enormous! so I'll apologise now if this question has been asked and answered hundreds of times....

I've had a letter sent out to me from Capital One saying that they are sending me a chq for £48. The difference between £20 and £12 for fees.
Should I persue? Is it worth it? I claimed for £120. Do they pay up before having to take them to court? I'm not sure whether I should just take the money and be thankful for something....

Definately keep going. They did this with me and still got the full amount back plus interest and court fee.

Just send them the next letter but add in that you will accept the £48 as part payments but you intend to carry on your claim for the full amount ;)

just trying to get my statements from cap 1 has been a nightmare. When I first called I was told there had been 66 charges applied to my account (66 x £20 = £1320) but after 4 phone calls I finally received my statements, showing 20 charges! I quickly fired off letter 1 anyway, and have noticed that the majority of statements have "supressed statement" on the top. has anyone else had this and what does it mean?
