    capital one didn't reply to my letter to ask for my charges back in the fortnight i gave them, i then sent a reminder giving them 7 days before court proceedings. they replied after these 7 days were up with an offer for £152 (claimed for £282). i have filled out the moneyclaim info, just need to process payment.

    do i need to let them know i am rejecting their offer or shall i just continue with the court?

    Can you please inform me of which addresses you sent your 2nd letter stating you'd take them to court, I haven't had a reply from my 1st one (asking for the charges back) I did send it to the :

  • I received an offer from cap 1 on 2 march for £390 of my £990 claim. I wrote and faxed back declining there offer but have not heard anything since can anyone tell me how long they have had to wait. Could really do with the money!!!

    In answer to your question, I think you still stick to the timetable of going to court with them, in your letter you should have stated that you take the £390 as partial payment and would still pursue the rest until you had a full amount.

    Just carry on with your claim - you could wait weeks for them to get in touch with you :rolleyes:

    PO Box 5283
    Nottingham
    NG2 3YJ

    Used the same address for the court forms as well and they paid up in full :D

    well i got a offer of £192 when claim is £779 and i declined and today if when cap one have to submit a defence on MCOL or i will by defualt.

    I just recived a letter from capital one saying that they've put a cheque for £90 in the post . my original claim was for £130 which i still maintain. do i keep the cheque when it arrive and battle for the outstanding? im not too sure what the protocol is!

    Yes I've had the same with them. They posted a cheque to me for about 20% of the claim.

    I just wrote back to them and said I will accept the cheque as part payment but I intend to carry on my claim for the full amount - then I just carried on as normal ;)
