  • Cap One acknowledged my claim on 13th March so do they have 28 days now from that date. Will 13th be classed as day one? Also my account is clear so do they normally repay in a cheque?

Fingers crossed I get money back

Ok, what stage are you at?

    First or second letter?

Either first or second, they should have been given 14 days. That's what it should have said on your letter, if you used the ones from this site.

The day they receive your letter, you count 14 straight days from then. If on day 14, you've had nothing, you then go to the next step.

They will issue you a cheque in most cases if there is no debt you owe them.

No the 28 days start 5 days after the claim was issued.

Sorry I have gone through the letter stages and was only offered the difference between £12 and the charges so have gone to MCOL but they acknowledged claim on 13th March so unsure what date they have til to respond.

I have just had an offer back of £111(difference between £12 and £20.) Has anyone tried to claim back interest at a higher rate as i was not being charged 8% for the credit card.

Is there a template letter for saying you will accept as partial payment but you are still going to pursue the rest.

    thanks for help in advance

I had this also. I just moved onto the next letter threatening court but added a paragraph in saying I will accept your offer of XX as partial payment but intend to claim the full amount ;)

I thought there might have been a template, any idea on raising the statuatory interest from 8% to the credit card company actual interest rate?
