    Hi,

    I've just received the first letter from Cap One offering me 25% of my claim.
    Obviously I want to reject so I called them and was spoken to by a lady who said that Cap One are correct and they will not be refunding any further charges. I explained about that everyone who claims from Money Online gets a result and she said out of 7million customers only a handful have been refunded?

    Do I send a rejection letter just to be sent another rejectione letter back or can I just start MOL claim now....

    I'm owed over 900 pounds and they have offered 280!!:eek:
    Claiming the following:
    Natwest : 2177.00 (Settled for 2127.00, paid today 14.3.07:beer:
    Cap One: (me) 853.00 paid: 1059.05 20.04.07 :beer:
    Cap One: (hubby) claimed 718.18 13.04.07
    Halifax: 1836.00 plus int 283.82 int claimed 30.03.07
    Ikea : 324.00 plus 38.70 int (paid 340.00 20.03.07!!):beer:
    GE Money: 114.00 claimed 15.03.07 Settled for 90 :beer: :beer:

    You must send the letter to say you are taking them to court before you actually file online.

    Send them a letter saying you will accept the 280 as part settlement but you intend to claim the rest back through court then carry on your claim

    Has anyone got the letter details telling cap one that thanks for the offer but will refuse and take them to court?

    Then so I just start the MCOL without waiting for their response?

    I'm interested in knowing in after filing the MCOL with Capital One do they in most cases take it right until the last moment or settle early during the process?

    Being in Northern Ireland the MCOL is slightly different in that they are given 6 weeks to enter a defence not the usual 4!

    I'm helping my friend claim back £419 from Capital One and they have sent her a letter saying they have credited her account with £152 - the difference between the charge and £12. Should she carry on and claim the rest?

    Also another point came up which is very interesting. She started her account in 2001 and because she got in a mess she destroyed her first card and cleared her account. However she has never received a replacement card which should have come out when the card expired which is every 3 years isn't it? So in 2004 she should have had a new card but never received one and obviously she didn't chase it as she didn't want the card anymore anyway but she didn't close the account.

    However despite her not having a card they still charged her the £20 annual fee and thats why a lot of the charges are on the account. Where would she stand with that?

    Definately carry on - they tried this with me but I carried on and ended up with the full amount + interest ;)

    I wrote my letter to capital one 12 days ago asking for a refund of charges amounting to £324. I phoned then today to see how things were going, well, the woman that i spoke to was evil! My account was paid off in 2001, my statements show a balance of zero. The hag on the phone says i only partially settled and they have refunded me the difference between £12 and £20 which amounts to £84. which they have took off my outstanding balance. I tried to explain that i dont have any outstanding balance, so she says she wants to see copies off statements that prove this! what gives them the right to treat customers this way?:confused:
    I have contacted the financial ombudsman, i have necer been spoken to like that in my life.:mad:
