    GO for the full amout everyone!!

    Even with the OFT saying £12 is a fair charge.. if you take the bank to court they would still have to prove £12 is what it cost them so you would still win.. and the bank know it.. so they will still settle out of court!

Well, i replied that they should owe me some money then as i get put on hold for a lifetime every time i call them and its not a local charged number or freephone number i have to ring!!
    Needless to say he couldnt answer me on that one, so i replied that they cant justify charging me that amount as i am paying off something each month of the arrears and i'm not going to get anywhere if they keep whacking on £40 each month!! So i was going to be looking into it.
    I have since kept up the payments with the loan but am really struggling to get the arrears payed off now! (snowball city!)

    My question is to you guys is; Can i just send the 2nd letter to them asking for the charges back? (i already have the statements) and have you got any response yet with them?
    Also, what address did you use? and will it affect my mortgage or loan? as i cant afford to re-mortgage yet or go anywhere else for my loan, may be able to re-mortgage later this year which i plan to do asap!!

    Any thoughtsor advice would be very much appreciated!

    Yes if you have already got copies of your statements go straight to the letter requesting your money back.

    for those of you claiming from Ge Money..
    I have now had a letter today saying they dont admit liability and the charges are inline with OFT ect ect..but they will refund my charges as a goodwill gesture!!
    but they wont be refunding my interest i only claimed £144.28 in total and they are refunding £120 in charges! so wont be going after the £24.28!
    this will be credited onto my account..i purposly left this amount on my card so they would pay it off as i didnt want the rigmerole of them sending me a cheque knowing how slack they are in sending out information.!

  • Hello all! first time posting on crap 1 boards! have succsessfully claimed for halifax and woowich so have started on my old, now closed crap 1 account. Just have worked out my charges(about £1245 inc interest!!!! Disgusting as my card limit was £200!!)But where should I post letter to? I see a couple of different addresses on here, but as i am sure this will go to mcol level (looking at what has happened to other people) and I am quite prepared to do so cos I HATE CAP 1, they are worse than any bank and have given me soooo much grief, I heard you cannot use po box no when filing and not sure if i can send recorded delivery letters to po box?? Any help would be great as ready to print and post letter today!!

    Stick at it with them - they will try all kinds of letters with you to try and put you off as they did with me but I got the full amount in the end
  • I sent my 1st letter off to Capital One outlining how much id like to claim etc
    Theyve got back to me today offerinf me £120 they say 'Financial regulations require me to advise you that a refund of £120 is my final responce in relation to this matter.
    Im sorry that I cannot refund all your fees

    So according to them thats all they have to say, so where please do I go now?

    I've noticed theres letters about rejecting Capital 1 offer. I wish to do this as they have offered me £188 against a claim of £600. I wrote to the them two weeks back stating I'd except £500 prior to the offer which arrived today but as stated i've got offer of £188 only.

    Can someone please state which letter I write? and do I give them 7days or 14 days to reply?

  • Capital One have refunded all my charges to the level of the £12 set by the OFT.

    Any advise?
