    I had the same problem with some accounts I didn't know the details of on my wifes behalf. The way I got round it was to get a credit rating report, I used Experian which gives you a comprehensive report of accounts and the current state of play. I does cost something like £10 or so but it will give you account numbers and how much is owed and what state the account is.

  • I've just received a letter back from capital one offering to refund the difference for charges plus a twenty pound acknowledgement of interest, this all totals £208 which is a slap in the face seeing as I'm claiming about £750.
    Obviously I plan to continue my claim, but I'm writing here because it seems that they've done something a little different to what other people have reported...

    They haven't sent me a cheque for £208, so I can't accept it as part payment before continuing with the rest of my claim, instead there is a slip I have to sign and send back to them accepting their final offer and that if they don't receive it back within four weeks they will automatically assume that I have accepted their offer and refund the money to my account, bit cheeky seeing as the letter is dated 3rd April and I only received it today the 15th.

    So 2 things, how do I continue this, just refuse their £208 and continue asking for £750, or accerpt £208 as part payment and tell them I intend to continue chasing the rest that I'm owed. The second thing is that I don't want the money refunded to my account, I want a cheque. I thought my account had been closed years ago but it looks as though it's still active. There is no way in hell I'm going to have another capital one, or any, credit card so how dare they assume they can refund my money on to an account they hold?
    Help, please anyone?!!

    I've had the same thing a couple of days ago.

    I was claiming £2600 (inc interest), they sent me an "offer" of £614 and £50 interest... :rotfl:

    I phoned them yesterday and politely informed them I would not be accepting their ridiculous offer and I would now be preparing a letter to the FO.

    I think your a little confused about them paying you back the cash, I'm under the assumption they will send you a cheque (can someone who no longer has an account with Crap1 please clarify)

    I would imagine the monies would be refunded via a cheque, especially if you have no account with them now. After all they can't just open an account in your name and credit it with £750
  • Hi everyone, not been around for a little while cos I've been mega busy. I'm about to send off my letter informing capital one that I'm pursuing the matter further through courts, but just wanted to ask what people thought of how I've worded the middle section of my letter, it's Martin's template but with a few bits addressing the points I asked about earlier...

    "I wrote to you on 26th March 2009 making the original request for a payment in settlement of my claim. I received a letter from Capital One on the 15th April, even though the letter was dated 3rd April, offering a total of £208 to be refunded to my account as a gesture of goodwill. This is not good enough. Asside from the fact that, as far as I was aware, my account had been closed upon my clearing of the balance several years ago, as was my request at that time, I do not want my money refunded into any kind of account with Capital One. The money is rightly mine, and should be refunded to me in the form of a cheque. Please take this letter as notice that I do not accept your goodwill offer and that I intend to claim the full amount claimed together with interest up to the date of judgment and court fees in the proceedings through the county court."

    Is that any good? Nothing that can get me into trouble there?

    Capital One are being a pain...I sent my first letter off on 26th Feb,requesting statements,although I didnt have my account number sent off all relevant info & 10.00 postal order.

    Received a response on 1st April stating they couldnt find an account with the details I'd provided....sent another letter on 2nd April verifying details & also enclosed a copy of my credit report,as they had placed a default on there,which confirmed all the provided details aswell.

    Today I receive another letter informing me,they have now found my account,but couldnt forward me the statements as I didnt provide the 10.00 payment!!

    I guess this means I have to send another payment of 10.00 & wait upto 40 days again.....I'm so sick of waiting now!!:mad:

    Sorry about long post....just feeling so annoyed with them!!:mad::mad::mad:

    hi trying to claim from capital one they have made myself and husband an offer which is ok but they are saying that they will pay it to the dca because the account was sold but the dca account has been paid off so could do with some advice on how to continue,

    Hi there,

    I'm looking for some advice please.

    A few years ago my partner got into a bit of a mess with his finances. I'm currently trying to reclaim all of his credit card charges from Capital One and Lloyds TSB.

    The Capital One claim is for £304 plus interest of £60.

    Over the period my partner had 8 charges @ £20 and Capital One have offered us the difference between the £20 charges and the new £12 charge. Their offer is for £56 (which is only 7 charges.... can't they even do simple calculations?!?). They have not even included any interest in their offer!

    I have written back to them informing them of my dissapoint at such a ridiculous offer and informed them that it doesn't even add up and that if I don't receive a satisfactory response I shall start court proceedings! They have written back stating that the offer of £56 still stands and is their final response.

    My question is... should I file online court papers or go down the FOS route?
