  • i have submitted a claim for a refund of approx £780 to capital one. they declined it, then i wrote the financial ombudsman service. the fos have written to me today to say that capital one have refused to make an offer that meets my claim. they say my enquiry is now being passed to the charges team at the fos who will investigate the matter in more depth. is htis the normal course of action? is this the point where they normally pay out? any help greatly appreciated

    Just a quick post for those that are just beginning to claim money back from Capital One, the phone numbers posted in the earlier pages of this thread are no longer active.
    I've just phoned Capital One and was told that to request a list of your account charges you need to write to:

    Executive Response Department
    Capital One Bank
    P.O. Box 5281
    Nottingham
    NG2 3HX.

    The woman I spoke to said that a list of charges would likely be sent free, although if I was requesting statements then they can charge me £10.
    I hope that helps someone.

    Does anyone know if I can claim back the late fee balance that I paid in full to Intrum Justia as my debt was passed on to them and I payed them in full around 4 years ago. Can I claim back what I paid to the debt collectors as the debt that was passed to them was made up of around £300 of late fees?

    I sent the first letter yesterday without the £10 so fingers crossed the send me it without charging. Thought I'd chance my luck first and send the £10 if they request it. Like you mine has been paid through a debt collection agency but I shouldn't see why that would affect it. At the end of the day you have paid the money. Mine was £370 in total but most of that was charges so I thought it was worth a try.

    Good luck with your claim, I'll be sending off the first letter today, wrestling with the decision of whether include the cheque for £10 or not cos I think I'm actually closer to the 6 year cut off point than I originally thought. If I don't there's the possibility that they could stall for 40 days and then write back telling me I need to pay them. The longer I give them to stall then the more of my fees dissappear beyond the 6 year void!
    Or is this not the case? Any experts know otherwise?

    Which number did you ring? Maybe the customer service woman I spoke to just couldn't be bothered! I sent my first letter off yesterday with a £10 cheque anyway, not too worried about losing a tenner, especially if they'll need to send my actual statements to warrant cashing my cheque.
