Cap one finally caved in and paid my claim in full - coist them all the court costs and the 8% interest for a much longer period than was necessary but that was their choice! Go for it and do not settle for less than the full amount!!£2 saver club £16 so far!! - it's growing!!! :j

Im reclaiming again after successfully claiming once before.But after this Im going to do the sensible thing and get rid.Its because I needed money for food that I ended up going over again .
I sent off my first letter asking for a refund and they have replied saying " As you`re probably aware the OFT hasnt challenged the right of banks to charge default sums, but merely the level of those default sums.Although we feel £20 is just a sum,we`ve reduced our default sums to £12 so that we are in line with our competitors.
However, I am unable to offer any refund as a gesture of goodwill, as your account default fees have been settled through a previous court claim,resulting in a refund of £1460.64.Therefore I consider this matter closed.
Does this mean that this is where I need to send off the 2nd letter stating that its not Credit Card charges that are going through the courts its Bank charges,therefore Im to continue with my claim?
Also, I need to double check that you can still claim £12 charges?

I've just won my claim with cap 1 for credit card charges through the FOS
I first requested statements 1st August this year so it took three months in total and well worth it just got to wait for the payment to come through as it's a closed account. Does any one know how long cap1 take to pay out? could do with the money before Christmas.0 -

I initially started the reclaim process with capital one approx 15months ago, i got as far as requesting the total amount of £1103 (which did include interes). They refused and offered a partial payment of £318! HUGE DIFFERENCE! And so i refused their offer.
The £1103 would of paid pay off my entire balance with them plus an extra £278, as my outstanding balance at that time was approx £825.
Unfortunately, at that time i was not in a position to be able to find the £100 (approx) to start/file a county court claim as recommended here. Time has crept by and i have not been able to make any payments to capital one, by way of repaying the balance. To be honest, as i was so incredibly skint it seemed crazy for me to find money i did not have to pay to them knowing that they owed me.
I have now paid off alot of my other debts, priority debts such as council tax arrears and am in a postion now to be able to restart my claim with capital one.
The problem i have though is that, as time has crept away i have now been threatened with litigation and formal demands have been made, so i feel time is now of the essence.
Also, as time went by my balance has increased to £1183.41, due the even more charges being applied. I have recently spoke to the company dealing with my debt "capquest" and they have offered me to discount the amount owing to £591.71, but only if i pay within 3months, and well i havnt made the 1st repayment as i feel i would be better to use that money to start/file my county court claim.
So, my question is this, do i start up a whole new process going back 6yrs from now or continue with the original amount i requested?
What should i do about this formal demand from them?
Would i be better to just pay the £591?
Any help greatly appreciated.

You need to keep making ur repayments to capital one, it will at least pay off some of what u owe them so if you get your money back that means more for yourself. The reason i am saying this is because if you do not pay they could harm your credit file (if they havent already but it could make it worse)
Make sure u claim your interest on top when you put in your claim for court.No you're not a vegetarian if you eat any animal or fish, so do not insult genuine veggies by calling yourself one! :mad:

But you see, the opportunity for me to make repayments to them has now lapsed.
I have limited funds, so should i start my claim OR pay them? I can only do one or the other.
And if the answer is yes submit the claim, should i continue from where i left off 15months ago? or should i start over going from 6yrs previous to now. If you see what i mean?0 -

after they offered me 12.00 per charge I decided to go to the Ombudsmen, wow can't believe how quick it was, from sending off my application to getting the full offer took about 5 weeks, just waiting for the credit to appear on my statement.
Stick at it guys its well worth the wait and I would seriously recommend the ombudsmen as oppose to MCOL as its free and surprisingly quick.

I claimed off Capital One a few years ago and they only paid me the difference to £12 but refused to pay £3 cash advances back which were caused by using the card at online bingo! They made the excuse that it was the equivalent of withdrawing the cash although Im not sure how that works as if I wanted to withdraw from the machine and have the cash in my hand that would be different wouldnt it?
Have you had any similar claims and do you think I should put in for a claim for each of the £12 plus £3 cash advances?
