    Just rejected an amount of £130 from Capital one against a claim of £522.

    Just filled in the paperwork for the FOS....

    Anybody know what the turnaround time nowadays is for the FOS ?

    my claim with cap1 has been with the FOS for two weeks and just had a letter saying they hope to get back to me within two months
  • I always pay off my credit card bill in full by direct debit from my Cahoot Bank account. When the statements comes I transfer the money from my current account into my Cahoot account so the money is set aside.

    Last month my statement arrived on the Friday and it said the money would be taken from my account the following Tuesday. I was worried that this wouldn't be enough time for the money to clear so that day I transferred the money into my Cahoot account.

    Capital One tried to take the money on the Tuesday money but the transfer from my current account didn't go through until Tuesday afternoon so the bank rejected it. I immediately called Capital One to explain the situation and paid the full balance by debit card. I asked them to increase the time between the statement coming and taking the payment in the future as a couple of days is insufficient and I didn't want this happening again.

    I have now received my statement and I have been charged the following:

    £12.00 Returned Payment Fee
    £12.00 Late Payment Fee
    £34.58 Interest
    £25.00 fee by Cahoot for the payment reversal

    Total = £83.58

    This seems a ridiculous amount considering capital one got their money only a few days later than normal. When I called them asking why the interest was so much they said if a payment is missed, interest isn't worked out on the number of days the payment was outstanding, but on the whole month. So they have charged me 14.88% interest on £3680.32 for the whole month when it was only a couple of days late. I can't see how this can be justified or legal.

    Do you think I am entitled to claim any of this back?
  • :mad: :mad: I sent a letter on behalf of my dh to them requesting the details of charges. They cashed the cheque early last week but he has just received a letter stating that they cannot action the request as the signature on the letter does not match the signature they have on file.

    !!!!!!?

    What should we do now?

    I sent a letter on behalf of my dh.....as the signature on the letter does not match the signature they have on file..........What should we do now?

  • He did sign it, just I did all the 'legwork' is all.
  • Well dh phoned them and he failed the security questions. They said the address and postcode don't match what they have on file - he gave the address we currently live at (obviously) which is where they sent the letter to saying that the sigs didn't match.

    We did move about a year ago, but updated the adresses.

    Dh asked to speak to the person named on the letter, but was told that he could only contact her by letter, not phone.

    Dh said he thought they were being deliberately obstructive and could somebody more helpful please call him back asap.

    Should also have mentioned - we have a dmp through CCCS which has been in place since 11/2005 and includes this debt (which is about 50% charges I would estimate)

    If I just briefly explain my situation. I recently sent the template letter and £10 to Capital One to ask for a list of charges for two credit cards that I had with them, one of which was passed onto a debt collector.

    They did cash the cheque but rather than receiving a list of my charges, I only received a letter referring to the account that had been passed on in which they say they have reviewed the account in question and they give me an offer. They then go on to say if I accept the offer I have to sign the form attached and they will contact the debt collector to let them know the reduction in debt.

    Now I have a couple of problems with this letter, first and foremost I didn’t receive a list of charges relating to both my cards (so I can't even tell if their offer for one of them is fair) even though they cashed my cheque, and also the card with the collector was paid off so who are they trying to say would be refunding me the offer they gave.

    Any advice on next steps would be greatly appreciated.
  • Hi i have taken cap 1 to court for charges, interest and defualt and all aderse info removed, they have said they are going to defend all the case but i got a letter from cap 1 this morning saying that they will pay in full charges interest and court fee and remove the defualt but will not remove late payment markers from cra's, also they have contacted the court to say they have paid in full and i should contact the courd to discontinue the case now, what should i do next, are the late payment markers just as bad as default? if i say no they havnt settled in full because of the late payment markers, how should i now go about it because their deadline to defend is thursday, and how do i know they will still remove default if i discontinue the case??

    any help is appreciated.

    I would call them and explain this, you paid for a list of charges and the data protection act requires they provide this within 40 days.
    Put pressure on them to provide the charges, inform them you can't accept or reject their offer until you know what the charges were.
    No you're not a vegetarian if you eat any animal or fish, so do not insult genuine veggies by calling yourself one! :mad:

    I would make sure you get a refund and that the default is removed before you accept and contact a credit agency like Equifax to confirm it has been done. However i would say that you want the late payments taken off as well, this is not good when applying for future credit and damages your credit score. I would keep on at them about this, Remember if they don't pay send some debt collectors to get the money!
