  • I don't have any advice really but just wanted to say that I think Capital One are using any tactic they can to avoid paying out - I requested statements for my dh (he signed the letter) and he got a letter back saying that his signature didn't match that on file, but they have cashed MY cheque quite happily.

    just looking for advice really! I have just sent my second template letter to cap 1 and rec,d a reply saying £40.00 is their final offer!! i requested fees off nearly £400 to be refunded. Do i carry on and fight????:rolleyes:

    Most definitely, £40 is nothing compared to £400!
    No you're not a vegetarian if you eat any animal or fish, so do not insult genuine veggies by calling yourself one! :mad:

  • Hi, just wondered if anyone can help me. I have just begun to reclaim my charges from capital one. However, I have contacted them and they have no record of my account which was closed in August 2004. Do they only have records up to a certain time or are they just trying to fob me off. Can anyone offer me advice on what to do next. I still have the account number but need to reclaim ASAP as its pretty close to the 6 year deadline for reclaiming

  • I thought banks etc had to keep all details for 7 years?
    Long time away from MSE, been dealing real life stuff..
    Sometimes seen lurking on the compers forum :-)

    I had this with cap 1 when I phoned for my statements. Did you send a letter stating you wanted the details under data protection act with a £10 payment?
    If you did and they still say they do not have the data report them to the information commissioner
  • No not sent the letter yet. Would I just need the account number or do I need to send any other details.

    Just use the template letter on the credit card reclaiming page on the main site put you account number on there send them £10 for the statements send it to them recorded delivery and just sit back and wait. They are allowed by law to take up to 40 days to do this and they probably will.
    Be prepared to go all the way to the FOS as I have, been with them for about a month now
