you cant have all the charges refunded. as long as they charge £12 or under then its their discression. if you have had any charges at £20 (which were reduced in sept 2006) then you get an £8 refund per charge0

just had first offer from Cap1 £226 plus a £20 good will gesture Ha ha ha! I have asked for £936 inc interest. So sent second letter will wait and see what happens.
Just a word of warning I have sent the second letter to the address on the acceptance form, when I took it to the post office to send it recorded delivery
they checked the post code and found it was the wrong one for that address and changed it for me. Could be a mistake, could be they have only just changed it, I don't know but check the address with the post office or your letters could go who knows where.0 -
i claimed £533 plus interest, just got offer of £200 (total of difference in fees charged / OFT 'fair level' of £12), with £10 for my trouble..
if accepted, they would contact 3rd party (a/c was sold on) to reduce balance accordingly..
is it worth accepting amount, or has anyone actually had cash refund, rather than a credit?
I am inclined to send f/up letter, unless there are any statistics being kept (MSE, anyone?) s to suggest otherwise..?

We were offered a similar amount which we refused. We then went through the financial ombudsman and got the whole amount back including interest. We were sent a cheque but although our account was still open we didnt owe anything on the card. I think if you owe them something they will just credit it back to your account. Dont accept this offer though.0 -
I sent off my SAR without any payment (as most ppl did'nt have to pay) i got a reply saying that as i did'nt enclose the £10 they will not be sending the information.

i claimed £548 and interest, just got offer of £200 being difference in the £20 charges made, and what THEY seem to think the OFT has said is fair (£12)..
the follow up letter tenplate only mentions threatening court - no option for reporting to Ombudsman ? Should I keep that surprise for next stage, or do I give them the frighteners now?
Iwould like some guidance as to how to phrase the letter, saying £20 fee is wrong, so the WHOLE amount s/be reversed as any payments made swallowed up by these, distress caused etc..
Also looking back through the statements, a lot of interest was charged on top of the fees, which would make up most of the balance o/s.. - is it too late to amend my claim to include these as well?
