    Hello,

    I have been working on my credit card reclaim with Capital One since January 2008. It took me nearly four months to obtain the list of all my default charges, which total £260. After writing to them requesting to pay them back, they offered only £96, as a good will gesture.

    I have wrote to them again, threatening to take them to court if they did not pay the full amount, to which they responded they are only prepared to pay £96.

    Has anyone experienced something similar? Shall I just accept the offer or take them to court?

    Any help or suggestions are much appreciated.

  • Capital One only seem to make small offers but many go to court and win back the full amount. I just need to re calculate the interest before i file my claim through the courts. The majority of advice on here is do not accept Capital One's first offer ... claim the full amount. Good Luck
  • Im oing through this process now. I filed a claim through Mcol 2 weeks ago, and they acknowledged the claim on the 4th. Im expecting a cheque any day now.

    I was advised to file through court and not MCOL but would like to hear how you get on so please keep us posted.

    Hiya, have included the link to a large thread about Capital One. Please do not accept their pathetic offer, I have just received notification of a FULL settlement figure via the FOS (Financial Ombudsman Service) and Capital One said the same to me.

    They offered me a small settlement figure so I put it in the hands of the FO and in the end I got the full amount back.
    So hold out and don't feel bullied by them.

    yes hang on in there baby go through MCOL or the FOS and you will win I don't know why cap1 and others are doing this with the small offers because they are wasting the courts and the FOS's time. They should have caught on by now that if some one is claiming they kow what the crack is and are not going to settle for less than thet are claiming for

    My capital One account was defaulted in 06 after they got silly with their charges and I couldn't keep up. So now I have paid off £500 to a DCA leaving a balance of 835 or therabouts. I am now writing to crap1 lol hopefully by the time they give me my charges back I won't have an outstanding balance to pay. WISH ME luck! will post in the morning recorded delivery.

    Sorry if this has been asked previously.

    Can I claim all the £12 fees back? As I notice they now charge £12 twice each month, so either way they get their full charge in.

    I wrote requesting charges including £12 back to the sum of around £650 back and they wrote saying ususal £12 is in acceptable fee and will only refund the difference and offered £32 back.

    Obviously I will write refusing this. Do the courts have an acceptable level. i.e.£12? Or will I get it all back.

    How long are FOS taking at the moment??
