    Capital One has started telling people it no longer holds details however, the Government requires them to keep records of at least 5 years for prevention of fraud and Inland Revenue purposes.

    Send a letter to the Information Commision, that should get them excited.
    Capital are just trying delaying tactics.

  • Hi,

    I just received a final offer letter from Capital One for settlement of 314 GBP. My claim is for GBP 1600. However, I have a small question as whether to go to court route or FOS route for my claim.

    I live in Scotland, so i can take them to sheriff court for charges from 5 years back which equals to GBP 1300. I believe you can claim up to GBP 3000 in Scotland now.

    For the charges before 2003, can I claim through FOS at the same time.

    I could claim everything through FOS, however, struggling to pay bills & really need to get my hands on this money asap.

    Any advice is appreciated.

    Read the above Posts. MCOL took me two weeks. FOS Will take 6-9 months.
    Simple conclusion.

    I am seriously wishing I had gone down the path of MCOL but I just didn't have the money to do it so the FOS was the only way. So far it has taken 6 weeks and my claim has only just got to the right dept!

    Can I withdraw the claim via the FOS and go down the MCOL route instead - really need the money? :o:rolleyes:

    Just carry on with the FOS, and do a MCOL too. No probs there.

    MCOL, what Capital will do;
    First send you an offer of around 20% of what you ask,
    REFUSE
    They will then send you the same offer as Final settlement telling you not to waste the Courts Valuable time.
    IGNOR AND CARRY ON
    Capital will say they are defending the claim
    DO NOT WORRY, THEY WILL SEND THE FULL AMOUNT BEFORE COURT.

    Have a " butchers" through the Capital One posts, they all had the same experience as me. Think of it like this, When you owed Capital some money, would they have excepted if you turned round and said i give you 20%? NO, so why should you except it.

    You just have to ignor Capital Ones worded letters and carry on. May the force be iwth you.

    I wrote to Capital one about a mont ago to get £72 back in charges they said no, I sent the second letter stating I would be taking further action they still said no but then at the bottom of the letter it said 'I look forward to recieving your signed settlement letter so we dont have to waste the curts time' But there was nothing to sign and they had said they werent giving me anything and there was no mention of a refund anywhere in the letter. Had they simply worded the letter wrong or do they just not have a clue what they are doing? Any way im taking it to FSO now.

    Sounds as though they cut and paste the wrong bit!

    I would write back and say that you welcome the opportunity of avoiding the Court's time and would welcome their clarified settlement proposal. May well embarrass them into making an offer.
  • Hi,

    Like many other's I've requested the whole amount of any charges Cap.1 have levied against me, the £20 charges from further back, and the £12 charges from more recently also. Totalling £460 charges and £106 interest.

    Around 6 weeks ago I was offered ( for the second time ) £114 which is the difference between the £20 and £12 charges, and told that this is Their final offer.

    I now have a bit of money to start the MCOL process and intend to do so this week. The thing is, since I sent off my initial claim, I have been charged another £100 ish in charges. Also, the interest owed to me for all of the previous charges would have increased.

    So when I start my MCOL, can I update my claim to include new charges and increased interest ?

    Hi all,

    I got a letter back from Capital One offering me £124, when I was claiming £360. It states that cashing the cheque means I am accepting this offer as a full and final settlement. Do I cash it and ask for the rest, or send another letter claiming the full amount again telling them that no reply will mean legal proceedings?

    Don't cash the cheque if that means you accepting it as full and final settlement. it looks like this is standard practice for cap1, take it to MCOL or FSO. You will get it all back it may take a bit longer but you will get it



    Still not had my statements yet
