I cant see whether an account was opened over the phone or in person has anything to do with it, the fact remains you have an account with them and they've added their rediculous charges.
Somebody with more knowledge can correct me if i'm wrong.
But i'm also in the process with CAP1, i'm still waiting for my 6 yrs over charges to be sent to me. I would of thought being as they've cashed the £10.00 i had sent, this process should be a little more speedy...FAST to take the cash aren't they!!!!!!0 -
Just got my statements back from cap1 totted the charges up and they come to just over £900 with interest. I am requesting the full amount back and from reading this thread cap1 don't like paying out in full unless you take them to court or go to the FSO is court still the best and quickest way to get them to pay out0

This makes no difference on the claim.
If you have a default on your credit file, due to these charges, you may want to add the removal of the default to the case. Many have been successful, saying that these charges had caused the financial trouble leading to the default.
This does complicate the claim, so if you are in need of the money, or don't feel ready to take it on, try and do it as a seperate issue after you get your money.0 -

Court is quicker, as Cap one usually back down immediately. There is the court costs, which will be recovered from Cap one. You cannot go to the FOS, if court fails.
FOS, although slower, is free. You can still goto court if it fails. Expect a wait of up to 6 months though, although they do seem quicker lately.0 -

Thats nonsense.
You just adjust the letter, and leave out the amount. The clock starts from the first letter, and the 8 weeks response limit starts counting down. If you are going to court, you can add the amount up later, once you have the statements, which can take 40 days..
If you are going to the FOS, you NEVER have to work out the amount. The FOS force Cap One to do it, and then you get the offer. Of course, if you do have the statements at this point, you can always then flick through and check the amount.
If you are sat around waiting for statements, you are wasting valuable time. What if the banks stop paying? Strike while the irons hot, and get your letter in asking for the money back, at the same time you request the statements!!
I know someone who was sat around waiting for statements for his current account, whilst i got my letter straight in. I now have many thousands back in my back account, whilst his claim is on hold because he was too late. Think on!0 -

No probs. They will probably offer you the difference between £12 and the amount charged. Its a while since i did Cap one, but check in the credit card success stories to see if the are still paying out as soon as they are taken to court. Last time i checked they were, but check again just before you are at that stage, to give you an idea of the best option at the time. Good luck!0 -

I am one happy person! I sent my complaint on the 24th of June to the FOS and got the letter today to say Capital One are paying the full amount!:j:j:j
Please do not be put of by the credit card companies bully tactics! You will get your money back, you just need to be patient!

Saw you're message about reclaiming charges over six years.I'm just about to do the same but not sure what template letter to use.Was gonna go with the one on the MSE site re CAP1 being fined by the FSA but this relates to misselling betweeen 2003-2005 and I had my card issued (and PPI in 2002.0
