    Mine took about 14 days to come but they are entitled to take upto 40 days. If you don't hear from them by this time i would contact the information commissioner as you are entitled to this information by law

    The 40 days you refer to....When does that time start?

    When they cash the chq ? Does the 40 days include weekends ?

    I have recently asked the same question and i was told yes, you can add on the new charges & update the interest. This can be done at any time up until you claim through the courts.

    Im wanting to clarify a letter capital one send me, at the start of the letter they tell me I cant have my charges back, at the end of the letter they say the look forward to recieving my signed settlement form to save the courts time only thing is there is no form to sign! I have phoned the main capital one number but they said I had to write a letter, does anyone know if theres another number i can try?

    I have recently telephoned the call centre to request full statements with details of who all transactions went to and from, having been sent statements with figures and no details.

    i have been informed that these details were on their system and they would have these sent out to me.

    i am very annoyed as i think this is another delay tactic from cap one.

    I think the next step will be to write a further letter explaining that i will be amending my claim to adjust for delay in time and will be adding the accrued interest on to my claim- if only i knew what figure this was at the moment.

    i have decided as soon as i get my statements i am not even going to bother with the initial letter i am just going to file with MCOl straight away.

    does anyone think this is wise?

    I can understand your frustration but to be honest i think you will be better off going through the motions and following the whole process.

    You will get a first response off Cap1 with a very low offer, followed by another letter stating that they are not going to increase the original offer, then you should think about court/mcol (most recommend court over mcol). If you go straight to the court and haven't given Cap1 the chance to make an offer, this may harm your 'defence'.

    This is just my opinion as i'm not an expert but i would hate for you to ruin your chance of getting anything back off them.

    Why are you waiting for statements before sending the initial letter? Just send a letter saying you want all the charges back with interest. You don't have to state the amount. This starts the process rolling.

    Yeah but it would help. I can't see Cap1 working out the charges for you and the template letter requires you to state the amount to be refunded, this is what gets the ball rolling. Anyway, they would only write back asking for the details, probably after the 14 day time limit, just to be awkward, so you may as well start off with all the correct information
  • Hi everyone,
    Could do with a little advice if possible :)

    Am currently at the stage of claiming £687 back from capital one (inc of the interest) i did ask for the money at first without interest but since the amount wasnt met im taking them to court.

    Thing is the card was closed about 9 months ago and sent to a debt collector (capquest) who i currently pay £18 a month to to clear up the card.
    I owe probably about £300 on that.

    Will this effect my claim? I filed through the claim at MCOL today paying my court fee...

    Im just worried that if they put in a defence that this will go againt me and i ont get anything back.

    Hi

    Can anyone help, I am trying to reclaim PPI charges from my capital one credit card, I sent them the letter off Martins Website and I have received a reply saying that yes they have been fined by the FSA, but my account is not eligible for a refund of charges due to the fact that it was set up over the telephone, i cannot remember setting it up over the phone as it was many years ago, i was sure that i took it out when i first opened the card! They have said that they offered a cooling off period of 30 days and that i could of cancelled it then!

    If anyone can offer advice please do so as i am confused and the total charges amount to £1500.00!!
