  • Hi, basically I have been offered and accepted £374.00 from Capital One :j - received a cheque and paid it into my bank. However, I was told by my bank that the cheque has bounced because of insufficient funds :mad: , what is going on!! I have been given the runaround yesterday by them and kept getting cut off. Finally I got through only by using my husband and his still active account - they have promised me a phone call on Monday with an answer. However, I was wondering what the next step would be for me - do I go to the FOS to reclaim this mutually agreed amount? Any advise would be greatfully received.

    capital one bounced a cheque due to insufficient funds !!! wow this should be national news surely.

    did they pay (try to pay) the total of your claim or was it a reduced amount? if it was reduced id reject the offer and take them to court for the whole amount.

    i would not do anything further by phone and only comunicate with them by letter. the fact they attempted to pay shows their laibility.

    ive been offered £154 by cap one i sent the second letter and a letter came back for the same amount, should i just accept or would it be worth it to go though the fos?

  • hi i have asked capital one to refund my charges off my c/card the sum of £1350 since jan2003 they have not replied to me and the cut off date was yesterday,
    question 1
    i am now filling in a small claims form for my local county court can any person tell me what % interest should i enclose with my claim and can i claim the court fees back
    any advice would be welcome

    I've claimed off Cap One - it was only when I did the court bit that they responded, as for Interest use the one on this site thats used for the Bank Charge Interest.

    Do a search on the main site you will find it no problem
  • may be worth sending a 2nd letter (recorded delivery- best wait til after the xmas rush..?), warning of court action, to show you've tried contacting them.. and maybe get some result before spending out on court fees..

  • hi had a letter off capitalone today offering a refund of £8 per charge which totals £400 +£35 interest
    question my claim is for all charges being £1364 and any interest involved
    do i accept this or still apply to the court for all fees to be repaid
    there offer would clear what i owe them
    any advice please

    Did you claim all the charges including the £12 ones? Where does the £8 come from?
  • yes all the charges £20 and £12 late payments & over the limit fees
