Been waiting for my cheque since the day the letter came. So from 26th, two weeks after that so basically they have till 10th Oct to get the cheque to me. I have been at the door ever since waiting to mugg the potie...ha...haa

sorry to repeat myself... but capitol one the easiest and quickest!
but you HAVE TO DO MYCOL... they defend BUT only so they can say they don't agree (legal stand point) but then pay soon after... my cheque was sent within two weeks.. did think it would take longer 'cos of postal strikes.. but they may take longer... due to lots of people claiming refunds so I'm sure they are VERY busy! lol
don't give up!
I didn't got through FO as they are not taking anymore claimants because of the test case - to my knowledge (technically for banks not credit cards)
all the successes are due to people taking the mycol route so I recommend that (apparently if you are in the hardship category you will not have to pay court costs... go to county court website for more info! might have to go to local court and fill out a form (N1????) not sure.. sorry!)
too my knowledge this is the quickest (and Simpley Be/ Ambrose Wilson - catelogue) the others took 8 months... I'm only waiting for Nationwide who havn't even bothered to write to me to let me know it's on hold - I'm going by other threads on this site!)

No the FO said that If I wanted to pursue any £12 charges (of which I had about 6), then they would have to do a seperate report as to how and why they justify non payment of that part. To be honest, had quite a good run and Crap 1 are the smallest so was glad of any offer. This was for huibby's card and just added mine up which amounts to about £300. My claim for £144 was sent through court on 23rd August, in September the claim has been suspended, and it seems to say I can not make another claim???

Glad to see that so many people are having success with Crap 1..........wish I could say the same.
Having to go via FO since small claims in Scotland only cover up to £750 and MCOL don't do Scotland at all.............10 weeks later (that's just the FO part) we are nowhere with them and Crap 1 keep phoning with 'threatening' calls amd more charges which we can't pay.
Getting really disheartened...........
If we take an offer thru the FO (If we get one) can we do it as part payment and not full and final settlement,then claim the rest via court?0 -

What if you sign an agreement through the FO for a settlement figure. These tend to end with the wording in full and final settlement. Does this mean that if it is not for the full amount you can still claim the balance or not. Have been offered £862 on a claim for £950, however have incurred another £80 since. If I accept the £862, could I then send them a letter with the remainder and additional charges listed, or would that be it?0

Just got word i have won 1000 pounds back which is the fully claimed amount. But i have yet to cancel the MCOL, i dont think i will until i get the cheque in my hands.
Is this sensible? Or can i safely cancel the MCOL now that i have a letter from them saying they will refund me >Halifax - Victory!
