    Taking the advice given on my other thread I have drafted this letter to Capital One in responce to their offer ( I have rehashed a CAG template slightly to take my own circumstances into concideration)

    this is my letter

    Response to settlement offer.

    Dear sir/madam

    Thank you for your letter dated ******


    I respectfully decline your offer as Full and Final settlement and request, once again, that you return to me all charges imposed on this account, totaling £***

    I will accept the sum offered only as part settlement and only if the amount is sent to me by cheque and on the clear understanding that I will pursue recovery of the remainder, with a County Court claim if necessary.

    My original letter dated 19th July 2007indicated that you had until 2nd August 2007 to respond before I proceeded to the next stage of my legal action. My deadline has now passed.

    If you do not accept my conditions, or you do not respond within 7 days, I wish to stress that I do not accept your offer and the money transferred to my account should not be viewed as my acceptance. I hereby authorize you to remove this sum accordingly.

    I trust this clarifies my position.

    filed MCOL on 6th september and Capital One acknowledged on the 11th september but still no letter from captial one offering the full bal (normally happens)
    I am worrying to early?? Or have they now decided to take it all the way and put stay on cases until bank charge saga??? How soon can I file a judgement?
    Can anyone help, or give any advice

    My claim is due to be deemed served tomorrow (Sunday) and I just at what point Capital One usually cave in at? I'm so impatient! lol

  • Hi Firemeup, look like we are around the same stage, well maybe I am slightly in front.
    Mine was deemed served on 11th. They then acknowledged on 11th too.
    still not heard anything from them and was expecting a letter thursday or friday 20th or 21st...but nothing.
    Normally from the threads i have read they normally have been in touch by then with full offer. Maybe it just normal....hurry up postman!!!

    Good luck anyway, let me know how you get on.
    plus anyone out there with more advice on my current situation please get in touch.

    Well, as you can see below, I was claiming £981 off Capital One, when someone mentioned the 'Self-Litigation Fee', as would be awarded at court if you represent yourself! This fee is awarded to cover the cost of all the hard work you have put into fighting your battle. There is a way to calculate it with so much per letter written and read, time researching the issues etc etc. So just like you would be charged by a Solicitor, you can charge these cost to the defendant when they lose! :)

    Here is a link to show you the letter I wrote and the statement I sent to Capital One that got their offer of £303 up to £1,489 - literally over-night!
