    issue mcol definately. you'll get full refund of charges plus interest plus court costs. you won't get anywhere unless you take them court. you wont have to physically go to court as they cave before then but you'll need to have started court action. from the time i issued mcol to receiving my cheque was about 4 weeks.

    I put a claim in against them for £120 and received an offer of a measley £44 this morning :(
  • On a side note, when putting a claim together through MCOL (my first one) do I need to add the interest on as well or do they do that?

    If I'm adding it on is it at the rate of the CC?

    I put the amount of the charges... then interest as a seperate amount then gave the total amount to be claimed ie: £240 charges, £45 Interest, total claiming £285.

    Not my exact amount as I don't have them on me but hope that helps.
    They will defend (they are just saying they don't agree that they should pay you back!) but then you will get a letter saying they don't want to waste court time, money... blah, blah... but will send cheque in two weeks... which I think has happened to everyone so far!

    now at Uni as a Mature student -update: now has a First Class BA!

    Also, when you proceeded with MCOL did you write to Capital One at the same time?

    Sorry for all the questions, am learning slow but sure! haha :)

    I used the MSE calculator on the main part of the bank charges reclaim bit! I'm rubbish at maths (I'm sure claiming against RBS slowed me down as I got the maths wrong!), I think that calculator is 8% but I would say best to check first.

    I only wrote 2 letters to Capital - I had statements so I just asked for the money back... then the LBA. I pretty sure that was it... then I started mycol and I was skint so I did leave it for a couple of weeks.
    I will have to check as my paperwork is at home but this one was the easiest and quickest out of the lot! in total it took less than two months but as I said I did leave a gap.

    my others started back in February and I wrote lots of letters to them.
    So it's just the catalogue and Cap one that were easy!

    I've had another catalogue give me back premiums from their payment protection & insurance as they missold it too me - I didn't even complain or ask for the money back... just to cancel it. They refunded the whole lot back and with 8% interest on top!
    I've had a good month! 3 cheques within a week! and won a competition - love this site :D
