i really don't believe the nerve of capital one. my account with them closed nearly 3 years ago after getting ccj. paid it off 2 years ago. i'm in process of reclaiming charges from them. now at the point just waiting to receive payment after they entered a defence on the basis of them paying me in full. post came this morning and saw envelope with cap one on. was thinking this is it - my cheque. opened it and was very disappointed and shocked. it wasn't my cheque - it was an application form to apply for another one of their damn credit cards!!!! can safely say i was not at all tempted and went straight in the bin.
now i've got that off my chest i'm just wondering what to do next. issued mcol on 18th aug. received letter from court saying it would be deemed served on 25th aug and they have 28 days to enter a defence. checked on mcol and it had been acknowledged on the 24th. had letter from court saying they had entered a defence on 28th aug. then received letter from cap 1 dated 29th saying that they will send a cheque within 14 days. i haven't received anything and the 14 days is up tomorrow. i haven't cancelled mcol yet. can antone tell me what i need to do next? thanks0 -
Well hopefully guys, we will all be opening our post at the same time! Just think how long this would take if the FO still had all the bank cases to deal with. Still get the impression that the FO are not putting pressure on them though. I read the FO site and they claim that after a third claim against a company, the company are charged - think Crap1 may be a bit more than that don't you!0

Yay. This morning I received a letter from Cap1 saying that £845 will be refunded back onto my card. Just checked the account and the balance is £845 lighter. It's nearly paid off so I can get them off my back. I filed with mcol 30/08 so it's taken 2 weeks to get my money. I was convinced I'd be the first they took to court. I am sooo happy.

yes you can. mine was closed over 2years ago. no longer had account number either. just sent letter with £10 cheque to release the info under data protection act telling them name - married and maiden, dob and the addresses i lived at while account was open. dead easy. i received my cheque yesterday. good luck0 -
