I phoned the FOS yesterday after sending in another letter saying I wont accept anything other than the full amount.They have this logged but are yet to hear from Cap 1. Same as you I've been told hopefully they will have some news by next week. I'll let you know of any developments! Spoke to a nice girl at Cap 1 yesterday who said an official offer hasn't been made yet which is strange because I was told last week a couple of different figures around £200 not the £503.03 I've requested. Fingers crossed
It does sound like we are on the same timescale! I have not spoken to them on the phone so have no idea if they wish to make an increased offer. However from what other readers have written, I am not expecting a huge increase either, let alone the full amount.
Keep me posted and I will let you know if I hear anything. Hopefully we can both have a successful posting in the same week! YOU CAN BUT WISH:A0 -

yes. just edit the part where it says exceeding overdraft limit etc to missed/late payments and over limit fees.0 -

I got my letter saying "no way" to the full amount and that the last offer was the final one.
Not accepting it but i will have to wait a bit to get the money together for mcol as i am not sure how much the court fees will be for just under £1000 of claim!!!
If anyone has an ideas as to how much it will be, it would be fab.

Degs, you were bang on with your timescale mate.... recieved a letter saturday saying ".....they don't agree with me but, will be paying me out in full......£945.
Taking off the £340+ i have on the card owing...(which they are deducting from the £945 and clearing my account....but not closing it:cool: ). they are sending me a cheque for £600+.....
When this arrives, i will be starting a m-col for barclaycard as they have paid me £346 of a £1,100+ claim.
Sorry post is a bit behind, but everything is happening at once....work has picked up and am doing on average 16hrs days....overtime!!!!!!
Hurry up postie....
One question though, Who/how do you STOP the m-col?....obviously once i have banked and cleared the cheque! :T .

Sorry if this has been answered but I know situations change over time.
When I was a student about 5 years ago Capital One made my life a misery.
I accepted a £200 limit credit card and very quickly got into a situation where I was paying £40 per month in charges (overdue and over limit).
This was my own fault, but once I was in that situation I found it really hard to get out.
I closed the account ages ago but I wrote to them recently to claim those charges back - £400 worth. They've offered me around £100 on the basis that those charges should have been made, but should have been £12 each not £20 each.
Should I accept their offer? Legally I think they are correct, in that when I opened the account they outlined the charges. But morally I think they are wrong in that:
They made far more profit from charges than they did from interest;
They, in my view, deliberately targetted people with poor credit ratings;
They increased the penalty charges unexpectedly from £15 to £20 seemingly at random;
Unlike my bank they were never receptive to requests to waive late payment fees.
I don't need the £100, I'd much rather fight them because they made my life so unpleasant - but would I have a leg to stand on?

hi alex, we have all been there , my account was closed about 2 years ago , i wrote and asked for my money back and got a good will jesture of £434 instead of the £1,130 but u will have to do mcol or the fo if u want it all back, they just offering pple a good will and thats as much as u going to get without fo or mcol, i did mcol like i think most pple have done, and ive had my money back and spent it lol so yes go for it and u,ll have ur money soon cheers jill0
