called the FO today for an update. They said they have not heard from them yet (think they were given a month to respond) but they have till next week. Then they are chased up. Do not think this is going to be very easy or quick. Has anyone been contacted by phone by Crap1 prior to a full offer??? They keep ringing but have not spoken to them yet - but then again this could be because my monthly payment is just overdue. Wondered how they responded with others. Thanks.0

I let you know about my success with reclaiming full bank charges from Abbey about a month ago via the Ombudsman. At the time I hadn't actually received a payment but it arrived within about 3 weeks.
I'm pleased to now report similar success with Capitol One credit card.
They originally offered around £150 as a "goodwill gesture" which I refused. Last week they settled the full £500 plus after the Ombudsman contacted them!
My advice is don't accept any old offer and don't give up. I feel sorry however for those who have missed the boat with the test case putting things on hold. It could be a lengthy wait.0 -

I sent off for my statements, got them, used the calculator to set up the second letter.
applied for 956 , offered 280. laughed loud at the twenty pound "goodwill gesture" for the "possible" interest incurred. but now, stuck.
I understand that i have to send a letter before action letter when refusing the offer but do you then do a recalculate of the charges as there is going to be a change in interest charges between letters? Sounds like i am thick as pig poop but just wanted to check before i send off letter three.
Thanks and apologises if anyone has offered advice on this. i have scrolled but i get headaches from screen watching for long periods of time! maybe i will be able to afford some glasses soon.0 -

you could calculate new interest total before sending lba put to be perfectly honest it wouldn't make any difference as cap 1 still wouldn't pay out until actual court action was started. you're best then just calculating the new amount of interest to put on court forms (just saves time) which will then still continue adding interest at a daily rate. good luck i've just had letter from court saying that they intend to defend so i'm expecting them to fold any time soon as thats what they usually do. i'm so happy. just had letter from cap1 saying they will be defending my claim because they are paying me in full. woo hoo. can't believe how easy and quick this has been.
sent letter requesting charges 13/07/07
received statements by special delivery 16/07/07
sent refund letter asking for 376 plus interest 17/07/07
received reply offering 174 31/07/08
sent letter offering settlement of 376 ex interest and threatening court - 8/08/07
received letter saying no way 17/08/07
issued mcol 18/08/07
acknowleded 24/08/07
defended 28/08/07
received letter today saying they will pay in full 376 plus125 interest plus 80 court costs = £581:j

How long did it take for an offer once FO involved? The FO wrote to them one month ago (this Monday) and have not had a reply from them as yet. So they are saying that they will have to contact them and push it along and it sounds like it could go on forever. Started this in June through the FO.0 -
Hi All. Just filed on MCOL for CAP One charges plus interest going right back to the six year cut off point so I had to exclude some. They offered me a settlement of £420 previously (when the total plus interest is actually over £1600) and credited this to my account before sending me the offer letter.
However when I declined the settlement they then took it back off again the cheeky beggers!!!
My card balance is about £500 so fingers crossed I should have a cheque for the difference by the end of the month.0
