    hi,i dont know if this helps but they offerd me less than i asked for i refused filled in a ni at court and won the whole ammont,good luck.mo

    Now file with MCOL, (moneyclaimonline) and they will give you the full settlement straight after they aknowledge the claim.

    They are doing this to pretty much everyone. Read the thread about Capital One that already exists that will tell you everything.
  • As has already been said,keep going this is just a standard ploy that all the credit card companies are doing and Cap.1 do seem to cave in when court action is filed.

  • If you have something in writing from them saying you have paid the balance in full and final settlement then I can't see how they can go back on that - threaten to report them if they do!
    They are terrible for 'threatening' their customers.

    With Nationwide I got a similar form from the court as they had said they paid me - only half of the claim so on that one I said no and want to continue as I've accepted as partial payment etc.

    So the court action will end anyway as Capital contact the court to let them know. I think they defend as standard anyway... I think everyone has got the cheque from Capital this way as well, so don't worry - expect a cheque within two weeks of the letter confirming the refund!

    Tomorrow is 2 weeks since my offer of a full refund. I actually have judgement against them as they forgot to defend.
    Rang today and I am really dropping lucky in getting to speak to a person 'it says there is a cheque going out to you , full refund it takes 14 'working day' This is nearly 3 weeks to most of us. She said that I should get cheque on 30 August

    send them a letter saying you only acept it as part payment and your claiming the rest back,good luck.mo

    I claimed £513 from Cap1 and was originally offered and paid £80 which I declined. Have just been offered a further £262 to add to this after going down route of FO which I started on 26/06/07. Going to accept as I was on payment plan for a few months after difficulties caused by maternity leave pay and they were very helpful. Don't accept 1st offer though as in total I've successfully claimed £342

    Hi Shamrock - how long did this take through FO - we started mid june and got a letter 2nd August saying they were writing to them to either justify charges or make an offer. How long did it take from this stage?????? Thanks.

    how much does it cost to file a claim? cap 1 have until 30/08/07 to reply to me but they owe my £580, offered me £252 I declined but said Id accept £400 as that will practically pay my rent for a month and we relly suffered when they were giving us all these charges, trust me!! Im thinking about claiming but Im not sure if I can go through with it or not. Seems REALLY scary! I was hoping to hear from them this week since theyve been really quick in replying to me all the other times (unlike barclaycard). How long has everyone else had to wait??
