    I agree and neither do business claims also but the banks are using it to stay any type of charge claims. This is why it's imprtant to apply to have stays removed especially for those types of claim.

    An update, a few thanks and then one final question...

    Firstly, I received a letter from Capital One onAugust 14th saying they are going to settle my claim in full - £1050. Bingo! This was following me taking the MCOL route - they folded fairly quickly, and am absolutely thrilled.

    With this in mind, I want to offer my sincere thanks to everyon on this board who posts help, suggestioons and support. Without you guys there is no way on earth I would have had this much needed success - so a huge and heartfelt THANKS to one and all...

    Also, to those in the middle of a claim or toying with the idea of claiming - do it! Have faith - you will prevail!

    Finally - I have one more question. The Capital One letter says I will have my cheque within 14 working days. They have now defended the claim on MCOL - what do i need to do when the cheque arrives? Who do i need to contact to let them know that the case has been settled?

    Cap1 only defend to bide time so your court will send you a “Notice of Defence that Amount Claimed Has Been Paid”. You have to tick the box whether you wish to proceed with the claim or not. Wait until you have the money in your account, then send the form back. You are given a month to do so.

    congratulations. how long was it between you filing claim on mcol and getting your letter. have heard they are pretty quick to respond. just wondering as i filed mine on 18th aug and was issued on 20th.

    £2040 Claimed, £2040 Settled!!
    Was offered the difference between the £20 and the £12,
    Then took MCOL route and was sent full settlement letter within 7 days.
    Nice one Martin.... and everyone else on the MSE boards, pity about my case against Natwest, was 1 week before MCOL when the test case was announced. 2 more closed credit cards too look at, then my nightmare loan from the Evil villains at Citifinancial.
    Keep going with Cap/one people, they fold fast at MCOL, and my phone has also stopped ringing 29 times a day!! that was worth the MCOL in it's self!!

    I received judgement against Cap One I eventually got a polite and helpful staff member by phone, Monday 6thAugust, who said that I will get a full settlement and a cheque which usually takes 7 - 14 days to arrive (They never take that long to take money out)
    Thursday 9th August- Letter received on 10th August full of apologies saying they will be sending a cheque and on reciept of thisl etter will I notify the Court that they have paid
    I had no,intention of doing this until cheque received
    However tomorrow Wednesday 22nd is the 10th working day and still no cheque
    I shall try and phone -not hopeful of response but I am tempted to ask for a warrant
    Advice please

    As they have now defended then your case will either be transferred to a local county court or they may have defended on the basis that they have agreed to settle in full and that this case should be withdrawn (this is more than likely). So wait until you have the money cleard in your account and then if you have not heard from you local county court write to MCOL informing themm that a settlement has been agreed which you have accepted and that the money is now in your account so you wish to withdraw your claim.
