The link to court costs was last posted in post 1453 on page 73. Taking on Capital One really isn't scary, they crumble within weeks after filing a claim.Reclaimed thanks to this site:
£175 Abbey Mortgage Repayment Fee, £170.03 Capital One Bank Charges £418.07 Lloyds TSB Bank Charges, £2,671.55 Mis-sold Endowment Policy, all for OH0 -
If cap one have added a default notice onto your credit file, include this in your claim stating you require it to be removed as it is intrinsically linked to the charges applied to the account.
I did this and they removed the default notice from my credit files.0 -

Im retracting this! Just spoke to guy from Capital 1 who says letter is in post for £219! Its getting smaller all the time! Thats it I'm going for full amount through FO. Don't care if it takes longerI claimed £513 from Cap1 and was originally offered and paid £80 which I declined. Have just been offered a further £262 to add to this after going down route of FO which I started on 26/06/07. Going to accept as I was on payment plan for a few months after difficulties caused by maternity leave pay and they were very helpful. Don't accept 1st offer though as in total I've successfully claimed £342

Started it by posting letter to FO on the 26th June so not too bad really but getting hacked off now with Cap1. I actually only received that investigation letter yesterday and the offer had already been sent back to the FO from Cap1 on Friday so looks like those letter are coinciding with the agreement letters? Hope this helps!Hi Shamrock - how long did this take through FO - we started mid june and got a letter 2nd August saying they were writing to them to either justify charges or make an offer. How long did it take from this stage?????? Thanks.0 -
people beware. i sent a £10 cheque in the middle of july for my statements. a few days later i read posts saying cap1 dont charge for this. after a couple weeks and the cheque not being cashed i thought this to be true. i've since started mcol proceedings which were issued at the begining of the week. i checked my current account this morning and they have cashed the cheque - 6 weeks after receiving it (i received my statements within in five days). not sure if me starting court proceedings has spurred them on to cash it. luckily i had money in my current account to cover it but others might not be so lucky and end up being charged by current account provider.0

well i asked for statements WITHOUT sendng a cheque at first 2 see if i could get away with not paying the £10.00 but they sent me a letter requesting the £10 anyway. So maybe what you heard isnt true in all cases, I know someone that didnt have to pay the £10 to ANYONE.0

Hi Guys
Just got my letter back today offering me £342
I am owed £958 pounds in fees, So obviously i am not going to settle there.
Will i write the letter threatining to go to court, or can i file to go right away to save time as reading here, it seems they try and fob you off with less and less each time.

You need to send a Letter Before Action before filing giving 14 days, then file on 15th day using either an N1 or MCOL.0

I have sent Capitol One a letter with the payments and Interest Calculator, it comes to approx £540. They have said that they are prepared to give me the difference between the £20 charge and the £12 charge and therefore they are offereing me £94 as a 'goodwill gesture', but that doesn't add up, if they paid the difference between all the £20 charges and the £12 they say it should be it would be more like £164 and thats without the interest. To be honest (as I have a £1,000 claim against my bank which has been stayed) I could do with £94 but feel its a bit of a paltry offer, can anyone advise what I should do.
The account is closed by the way, it was paid off in full.0
