I have sent Capitol One a letter with the payments and Interest Calculator, it comes to approx £540. They have said that they are prepared to give me the difference between the £20 charge and the £12 charge and therefore they are offereing me £94 as a 'goodwill gesture', but that doesn't add up, if they paid the difference between all the £20 charges and the £12 they say it should be it would be more like £164 and thats without the interest. To be honest (as I have a £1,000 claim against my bank which has been stayed) I could do with £94 but feel its a bit of a paltry offer, can anyone advise what I should do.

The account is closed by the way, it was paid off in full.
hi sue my account was closed about 2 years ago but i got me statements and mine added up to £1,130 i got a good will jesture of £434 , so i sent a letter back saying i would accept this as part payment , when i phoned up the lady said thats all they were going to offer me , so if u want ur £540 u will either have to do mcol or go to the fo but i did mcol , and then u will get all ur money back i have had my money back and spent it lol good luck gill btw i have my tsb stayed which is for £4,000 so i think u should go for the full amount of cap 1 cos u will get it
  • i got a letter from cap one saying they would pay 216.00 when i was asking fot 957.00 wrote back accepting as part payment but i wanted them to pay it all back they wrote back and said no they would not pay it all. so i sent off to fo that was begining of july still have not heard from cap1 or fo.

did you send a LBA letter beginning of july? (letter before action)?
I would start court claim now or give them another week if you want to send a LBA.
They will not pay out unless you start the court process.
The usual process for cap one is
start court - they defend - you get another letter approx the same time saying we will give you your money back, expect a cheque in two weeks... two weeks later - cheque arrives! yay!!

THEY WILL ONLY PAY OUT IF YOU START MYCOL!
I guess they think if someone is not serious then they don't pay out... if you are serious then they will... this is the easiest one - I just wish my others did the same! I started my others in February! and they are credit cards but judges are putting a 'stay' on them anyway! *sigh*

keep going - don't give up... this one's easy!

Light bulb moment April 07: [strike]£3,655 [/strike] Oct 07: [strike]£2,220[/strike] now 0 - 3 years of Uni debt to be added at a later date :o:D

  • Cap one rock for charges tbh

Halifax STILL aint ackonwledged my letter, over 3 weeks now.

Even the RBS have written to me.
    Halifax - Victory!
    Capital One - Victory!

RBS - Cannot claim as it is a store card

This might not be true.........I'm going thru FO with Capital One. They must have panicked when they got the letter from the FO as they have suddenly upped their offer to me after saying they wouldn't - it isn't the full amount but alot more than the original offer (about 3 times as much).
But since they have and are still hasseling me I've said no and will continue my claim. If I've no joy with the FO then I will take it to court even although I'm in Scotland so can't use MCOL and it's over the small claims limit up here.
    Fingers crossed!

Hi Shamrock -looks like we are on a similar time scale. Started through the Fo mid June. Got a letter 2nd August saying writing to them to justify etc. But I have not had an offer at all through them yet. How long did this take you? Can you refust the amount and barter for a higher amount theough the FO or is the offer final?

I havent officially received the offer letter yet only spoken to Cap 1 on phone and been advised about the offer for £262. In anticipation of it arriving I posted another letter on Friday stating I wont accept anything other than £500 and will continue to pursue through the FO. When the offer letter finally lands hopefully this week I'll decline and push for the lot. Will let you know!
    ;)
