i got a letter from cap one saying they would pay 216.00 when i was asking fot 957.00 wrote back accepting as part payment but i wanted them to pay it all back they wrote back and said no they would not pay it all. so i sent off to fo that was begining of july still have not heard from cap1 or fo.
what should i do now?0 -

did you send a LBA letter beginning of july? (letter before action)?
I would start court claim now or give them another week if you want to send a LBA.
They will not pay out unless you start the court process.
The usual process for cap one is
start court - they defend - you get another letter approx the same time saying we will give you your money back, expect a cheque in two weeks... two weeks later - cheque arrives! yay!!
THEY WILL ONLY PAY OUT IF YOU START MYCOL!
I guess they think if someone is not serious then they don't pay out... if you are serious then they will... this is the easiest one - I just wish my others did the same! I started my others in February! and they are credit cards but judges are putting a 'stay' on them anyway! *sigh* :mad:

Halifax STILL aint ackonwledged my letter, over 3 weeks now.
Even the RBS have written to me.Halifax - Victory!

This might not be true.........I'm going thru FO with Capital One. They must have panicked when they got the letter from the FO as they have suddenly upped their offer to me after saying they wouldn't - it isn't the full amount but alot more than the original offer (about 3 times as much).
But since they have and are still hasseling me I've said no and will continue my claim. If I've no joy with the FO then I will take it to court even although I'm in Scotland so can't use MCOL and it's over the small claims limit up here.

Hi Shamrock -looks like we are on a similar time scale. Started through the Fo mid June. Got a letter 2nd August saying writing to them to justify etc. But I have not had an offer at all through them yet. How long did this take you? Can you refust the amount and barter for a higher amount theough the FO or is the offer final?0

Yippppieeee , Cheque in my hand , for the amount I asked for plus costs and interest £1143.19...
just going to wait till it clears before I cancel the MCOL...Im not really mad...0 -

Well done Degs45, dont spend it all at once lol! Did you pay mcol or did you just threaten them with it. They offered me £94 when I want 554, do you think I should do the same?0
