    You should have recieved a letter from the FOS, stating that they have 8 weeks to reply. Its only been a month.
  • I've answered my own question haven't I?

    I'm not desperate for the money and I can afford to take them to the small claims court so I'm going to do that.
    I'm a legal journalist so in a way I hope they do take me to court - if I lose I can write an article about the experience. It will be published nationally guaranteed, and I can send it off to the student publications too. The bad publicity it would bring to them, for me would outway the £80 cost of taking them to court, so sod it - bring it on, I'm in a no-lose situation.

    I've posted my letter before action, I'll let you all know how it goes.

    I got a letter from Capitol One about 3 weeks after the Ombudsman informed me they would pay up and the money went into my account the following week.

  • The FO received my complaint against Cap.1 on 16th July and since then nothing..........Everytime I phoned it's 'being looked into',haven't even got the 'they have 8 weeks to respond' letter. :confused:
    Having the same problem with the OHs claim aswell. Very frustrating.

    And here was me thinking the FO would have more time to deal with cc claims now the banks were on hold.

    Did you get all you were asking for or just the difference between £12 and anything over that?

    got a letter saying we wont increase our offer, take it or leave it our charges are fair they were in the T & C.


    Costing 80 quid to start the MCOL but hopefully this will be all resolved soon now as im mocing house next week

    got a letter saying we wont increase our offer, take it or leave it our charges are fair they were in the T & C.


    Costing 80 quid to start the MCOL but hopefully this will be all resolved soon now as im mocing house next week

    Don't worry... about a week after starting mycol they will defend and at the same time they will write you a letter saying...refund in two weeks... I got my check within the two weeks! and you will get your £80 court fee back too.
    This was the easiest and shortest claim!
    I've not heard of anyone who hasn't got their cheque within weeks of starting mycol... very usefull especially if your are moving house :D

    now at Uni as a Mature student -update: now has a First Class BA!

    Help!! Received a letter yesterday from Capitol One[we like to call them Crapitol One] Only 6 days from when i sent mine asking for approx £240 in charges. Capitol One have said they will pay me £72 as a goodwill gesture. I don't want to accept and i have no idea what an mycol is or how to claim in court.:confused: Soz if this seems thick:o. Any ideas,suggestions would be greatly appreciated
  • Its magistrates Court Online and its very easy to do, I have done it with Abbey and am about to do it wiht Capitol one, it will cost you £80 for the amount you are claiming back, but you will get this back from Capitol One when they pay out

    read my post above... Crapitol are easy.. .they roll over right after the mycol stage!
    keep going... hold out for all of it... I got the full amount + interest + mycol charge.
