    send them a LBA (letter before action) for 7 or 14 days - then start mycol after that - they then send a cheque two/three weeks later... so far this has happened to everyone who followed the same route.
    This one is the easiest to claim from!
    You do have to do the mycol bit but you'll get the fee back too.

  • Lee I've done all of that weeks ago. When I received my statements, I tallyed everything up (using this site) and sent the first letter asking for my mony back along with a copy of the statements. But I received no response. Then last week I sent a second letter saying that they had not acknowledged my claim and they had 14 days to settle my claim or I will take them to court.

    This morning I got a letter saying we think our charges are fair but as a gesture of goodwill we will refund you £262 of the charges (a difference of between the £12 ruled fair and the amount you were actually charged).

    What I wanna know now is, has anyone else got this letter? And... should I go thru MCOL now?

  • I've just been to start my LBA letter to send to Cap1 but realised thats the same letter I sent last time after I received no response from letter 1. Do I need to send this letter again, refusing the £262? Or shall I now move on to MCOL. Sorry if I'm confusing everyone

    If you have sent the LBA then file at court. I recommend using the N1 route rather than MCOL as you have more room to add POC info.

    I GOT THE SAME LETTER LAST WEEK AND REPLIED SAYING NO DEAL. TOLD THEM WHAT I WAS PREPARED TO SETTLE FOR BUT IF IT COULDN'T BE RESOLVED THAT I WOULD TAKE COURT ACTION. RECEIVED THEIR REPLY THIS MORNING SAYING NO WAY. SO I'VE JUST THIS MINUTE FILED A CLAIM ON MCOL.
    MY ADVICE SEND THEM A REPLY DECLINING OFFER AND TELL THEM YOU ARE PURSUING COURT ACTION. THEN FILE CLAIM WITH MCOL. SIT BACK, RELAX AND WAIT FOR YOUR MONEY.

    Yes it is their standard letter now to get you to acept the lower amount I wrote back and said that I would accept the lower amount, without prejudice as part payment and started MCOL . I stuck to Martin's timescales I heard nothing more, not even at the 3 week stage as others have done.They diod not atthis stage credit my account with lower amount as they had stated .Got judgement against them as they did not defend Rang up at the point when I might have had to take out a warrant. Finally spoke to staff ( 3rd Time) helphul ,apologetic ,had not recieved court papers etc but would credt my account with £400 and send balance by cheque within 14 days Still waiting for this

    My Advice start MCOL.

    what a result.......

    sent claim in with mcol on 30th july was acknowlaged on 2nd aug, deffendend on the 6th aug and today the 18th got a nice letter saying they have now had time to look into my account and are willing to pay me 1182.23 in full and final (even though i only claimed 1000.28) and will be posted out within 14 days. so could i please stop the court case as not to waste any of the courts time.....why yes i will as soon as the damn thing clears my account i will.YEEEEEHHHAAAAAAA. what a difference a court case makes does it not, before i started mcol i were getting very snotty letters telling me a offer of £90 YES £90 were all they were going to pay me so i should take it, because they would not be upping their offer and would not be replying to anymore letters.....well heres one for the little man i say!.........

    my advice is to go ahead with the court case and let them make the next move.. i were worried what with the test case and all that, but seems crap 1 have more to be worried about.my account with them is now clear i will be cutting my card up and spEnding MY MONEY on me.....thanks for everyone on here for their advice.......cheers

    Do not cancel the claim until the money is cleared in your account.

    How much are the court fees for a claim of around £990 plus int? How do I find out without going through the whole MCOL process?
