Well done on your claim.
Wish I was having the same success,Cap 1 are not helping at all and are even continually phoning me asking why I haven't accepted their payment as I won't get anymore and demanding payment on my account even although I am still making payments.
FO still have it as pending but haven't started looking into it yet even after a month.0 -

they are obviously hoping you will take the reduced amount!!
Have you sent them a LBA (letter before action)? if not send one saying they have 7 days until you start Mycol... once they defend you will get a cheque within a couple of weeks... I'm not sure about the fact that you have a pending case with the FO - if someone else can confirm that it's still ok to start court proceedings then I would say go that route... it's the easiest way with Capital.
demanded refund on the 12 June
sent letter to say no to tiny amount offer - 22 June
Started Mycol 13 July - defended 23 July - letter to offer ALL on 2 August - got cheque today!!
So from initial letter to actual cheque in grubby paws = two months
A breeze compared to the others which I'm guessing have all 'stayed' and started back in February.
keep going! :beer:Light bulb moment April 07: [strike]£3,655 [/strike] Oct 07: [strike]£2,220[/strike] now 0 - 3 years of Uni debt to be added at a later datenow at Uni as a Mature student -update: now has a First Class BA!0 -
I can't use MCOL since I am in Scotland and the amount claimed is over the limit for small claims here hence why I used the FO route...........:(0

Just to put peoples mind at ease, I have had a letter off Crap1 today saying that they will pay up!!Yippee!! I was getting a little worried as they defended on 30 July and was expecting a 'cave in letter' when a letter arrived from crap 1 saying they could' neither defend or accept my claim as they had no record of my account number or address' (I have moved since having my account with them and also married and so surname has changed) I sent off a snotty letter to them giving them the details but also saying that they had all my details last week when they made my rather rubbish offer of £414,and I felt that they were just trying to stall and waste court time plus i sentcopies of various letters sent by them to me, and 3 days later they caved in and agreed to pay me £1345 (amount+interest+court costs) Awaiting cheque right now and will cancel court action. A word of warning, this was a closed account that had gone to the DCA Lowells, to whoom I still owed £600, and crap 1 has paid off DCA and are sending remainding money in cheque to me. Now I was going to pay Lowells anyway and so dont mind but feel this is a bit cheeky of them.
They say that they have 14 working days to send me cheque anyone know how long that cheques take to arrive? I am off to Oz for holiday in a month or so and this money has really helped my spending fund!! Thanks to this site and martin!!!! Good luck to everyone claiming, YOU CAN DO IT!!!!!!Halifax- settled £1800 (spent)
Woolwich settled £505 (spent)
Capital 1- settled £1345 after defending on mcol (aw:j :j :j0 -
Just a quick question,
Asking for £760 charges back + £102.78 interest. Recieved a letter offering £276. Returned a letter to them that i'd accept this as PART PAYMENT only but will chase the rest through the courts.
Recieved a reply stating that they will not be increasing their offer, but the £276 offer is still open.
Do i now start m-col proceedings for the full amount?.....I keep hearing about an LBA (letter before action)........Not 100% sure

Your LBA is the letter you sent asking for the money before you take action, i.e going to the court.
From what ive read on here, you should now file with MCOL and wait for them to make you that full offer.
Mine is about to go in the post :j0 -
