    Many thanks.... Dave and Jill, it was just a remark that Dave made about 'sorting Cabot out later, that has confused me!! Lol, If I get the full amount back from Capital one, plus interest etc, surely I wouldn't own Capital one or Cabot (who Capt One sold the debt to) anything, would I?, as all I own these people, is money from Late Bank charges, am I right????,as that is what I have paid, many thanks....Lilly ;) ps..I have actualy paid them about £1100 on a £200 credit card, and they are saying I still own them more or les that amount, (all late payments I might add!)

    My Capital One account has been in an IVA for a year now, and im about to ask them for my statements as they owe me around 4 times what i owe them, im sure.

    Anyway, i was about to post the letter off and i recieve a mail today saying they have sold my account to Max Recovery and that they will be informing my supervisor too. They say if i have any queries about my account to mail Max Recovery and not them.

    Who do i ask for my statements, Cap One still?

    Did you record the call, you could email it with an official complaint!
    Did you try ringing again.. I know.. .I never do as I think I'm going to get the same response but there should be several agents if not up to 25/30 different people in that department. But it might be worth trying one more time - and record it too - on a mobile phone once the call connects you press 'more' and at the bottom of the list it says record.

    Well 3rd time lucky.Yesterday I got a polite and helpfulstaff.Again not allowed to put me through to that dept -no phone links !! Found info for me- Cap one only received judgement and paperwork the day before but are refunding me all. M y account and then refund the balance Said I would like it noted that I expected a cheque Did not want it paying in to a closed account .Confirmed a cheque was coming out but would take 7 -14 days .Pity their charges dont take this long to cme out
    Dont want to count my chickens but looks like another success. This is two via MCOL and this one much quicker
    Silly -as I originally would have settled for £650- ish intially and now they are paying out £1200

    Fed up waiting for Crap1 to settle through the FO. Hubby had a letter from FO saying that they have written to them and will be in touch around another 3 weeks. SO long and drawn out. Been going on now since June. What is Crap1's normal procedure from here? Has anyone else used the FO to reclaim??????????????????????????????????//
  • Am in the same situation as you - sent info to FO about a month ago and nothing. Cap 1 keep phoning asking for their money coz we wouldn't accept their poor offer and all FO can tell me (over phone,still no written confirmation) is the claim is ongoing,no time scale or anything.

    Are they allowed to keep hasseling us when we are still making monthly payments?

    I certainly don't think they would be allowed to keep harrassing you on the phone. The FO do not tell you a thing, even now they just keep telling hubby it could be another 6-8 weeks. I will keep you updated as I pressume they have a standard procedure even through the FO.How long has your case been with the FO?
  • About a month,the paper work was received by them the middle of July.

    well i received a letter this morning saying they would not be changing their offer and that 158 punds was paid into my account on the 2nd august, i checked by phoning for balance and it has been done. So now i need to claim the remaining 568 pounds through moneyclaim. But how do I word my POC. Do I just put in the POC that I am claiming 568 pounds inclusive of interest or do I somehow have to break it down??? How can I break it down if they have just refunded a lump sum?? sorry to be thick .
    Lloyds tsb. Won 913pounds
    Capital One Bank . Won 806.18 pounds.(awaiting cheque)
    G E Money . MCOL CLAIM FOR 330 Pounds. :beer:

    I could not find a way of breaking it down on MCOl and just claimed for the whole amount +interest initially. Don't worry too much as they wont overpay you an d it will not go to court . However they did not credit me the lower amount. I wrote saying that I was onLy PREPARED TO ACCEPT , WITHOUT PREJUDICE,AS A PART PAYMENT AND WOULD BE PURSUING THROugh MCOL I then heard nothing for weeks despite being given judgement by the court I have been now told thatthey are paying the full amount that I claimed £ 400 into credit card and the remainder by cheque

    Problem is in my lba I said I was prepared to accept the lower offer without prejudice and would be reclaiming the remainder thru court, does that matter?
