Just to say I'm new to this site, so I'll be no doubt asking advise here! Only sent my letter off yesterday to Cap 1 to ask for statements. The card was paid off & went to CCJ about 2 yrs ago, so about 4 yrs worth to claim, so here goes!!
HSBC Claimed £9922 - went to FO, Bank offered £9922, waiting for the money to go into bank!
Cap 1 Asked for statements
Barclaycard Asked for statements

Well recieved my second letter today and frankly its pathetic I'm claiming £300.............. they offer, by the usual payed into account trick, £72 :mad: I of course phone to complain and request the matter be reviewed again only to be told that the Customer Relations department 'Do not' take calls 'EEEEERRR OK ?' :mad: but I could fax them. I said ' No thanks I'll just contact the Court as they answer the phone' and left it at that.0

JUST READ THAT A PERSON WENT TO COURT AGAINST A CREDIT CARD COMPANY AND IT WAS STAYED UNTILL AFER THE CREDIT CARD....I HOPE THIS IS NOT GOING TO BE THE NORM..........NOT HAPPY.........:mad:
about a week after starting mycol I rang customer services who put me through to another dept and they said my cheque had been posted out to me... still waiting for the cheque - hoorah! :j
I don't think anyone who has asked for charges back with Capital have had to go to court they send the cheque soon after the court bit!!! This one is the easiest... took about a month in total!
One strange thing about mine is that they send the cheque is for £298.33 (includes interest & court charge) but the cheque will be for £278.33 - what's the £20 for... my account was paid up and closed nearly two years ago... if I still owed them £20 why didn't they tell me??? very weird. I'm not sure I care that much about £20... I'm just chuffed I got the rest!
I know that Monument have put a say on the court case.. which is annoying for me as I've had 3 years of hell from them and is the main reason I started the claiming my charges back... £500 in charges from Monument just for being 2 days late (and I included the extra charge payment to cover me! so why did I pay £90 per month in charges for 5 months???) lot's more hell from them over other stuff - I was hopeing after my court date of the 6th sept would be the end of it! dammit :mad:Light bulb moment April 07: [strike]£3,655 [/strike] Oct 07: [strike]£2,220[/strike] now 0 - 3 years of Uni debt to be added at a later datenow at Uni as a Mature student -update: now has a First Class BA!0 -
I sent letter one to capital bank requesting charges of 628pounds plus 98 charges,I received a letter back offering, "as a matter of goodwill" , a refund of 148 pounds plus 20 pounds for any interest incurred. Ms Renshaw said that the money would show on my next statement.
I wrote back, in form of an LBA that i would accept the offer as partial settlement withiout prejudice and would continue amy claim thru the small claims court for the remaining 568 pounds.Im not sure whether to go ahead and claim the remainder thru moneyclaim or just go for the whole amount as I dont trust them to credit my account with their "matter of goodwill".

Well, if you put a claim in for the whole amount and they pay some, you will have to amend the claim for £35. If you put the claim in for the part amount, you might lose out on the rest. It's your call.Reclaimed thanks to this site:

They normally pay up when they send the letter. Dont you have online or telephone access to your account?
Then, when you file with MCOL, they back down and give you the lot.
Mind you, that was before the OFT shambles, which credit card companies are abusing.0 -

I too was unsure like you, I was claiming £815.61 & was offered £226, which I rejected twice & went throughthe MCOL route it cost me £80 but Capital one gave in & have offered me £815.61 + £80 costs.

Claimed £815.61 inc interest on 14th June
Offered £226 on 20th June rejected offer on 21st June
Commenced MCOl action for full amount on 23rd July
Cap 1 acknowleged on 31st July
Responded with offer of full amount on 8th August.
What a letter from Cap 1 sorry you feel etc, conditions were known to you etc however as a gesture of goodwill & so as not to waste court time blah blah we will pay you the full amount.
Aren't we the good guys in saving court time & giving you all this money.
Ok I was irresponsible but that doesn't negate the over charge issue & those countless damn telephone calls in the middle of my evening meal .
Now for the next claim on my second Cap 1 account.
My advice to anyone else claiming is stick with it cus they cave in at the end
