    How do Crap1 react to the FO claims? Do they offer full amount or am I going to end up going down the court route anyway?????????

    Try ringing again... remember call centres have hundreds of people in them and some of them are unhelpful because they are not too bright but there are some decent ones - I know I used to work in one (never again!).
    Also, try asking for a manager to talk to - or team leader - they are more helpful and have more knowledge - you might of got someone new or just plain stupid!
    good luck and don't give up. (also I didn't get a letter - I've heard nothing since the mycol start - I only found out because of ringing (Jill told me to :D ) and postal strikes are slowing things down!

    Asked to speak to Ms Renshaw,Executive Office Manager "No , this dept does not have an extension"
    I asked to speak to,Ms Renshaw
    "No telephone link You can only comunicate by post"
    I asked tospeak toa manger
    No you cannot. I have told you that I cannot put you through .Why are you telephoning?
    Then the broken record technique
    I asked to speak to his manager or team leader as he was becoming ruder
    No and No. I asked for his name and demanded to speak to his superior He said he would put me through and made an attempt , also put the music on and I suspect he was doing nothing as he kept doing this and coming back with "it is engaged" After 20 mins of this game I had to hang up, frustrated with blood pressure up Now at aloss as the 21 days some have mentioned is passed and the time is nearing to issue a warrant.

    Hi people,

    I got into a pickle with my capital one classic card. I ended up with a balance in the region of £700 yet my limit was £200. Nearly all of the debt is made up of "late payment fees". I ended up recieving a CCJ for £240 which I thought was suprising! I have now paid the CCJ amount off and have a remaining balance of £460 which will be gone in 9 months or so.

    I was wondering if you think I have a case to try and reclaim the charges? I would be happy if Capital One just wiped out the outstanding amount as they are willing to accept a £300 one off payment.

    How does having a CCJ satisfied affect my credit rating?

    I was thinking if I claimed back the charges and won could I get the judgement removed as Cap One are essentially admitting that the charges were unfair?

    Any advice you have would be so greatly appreciated!!!!!

  • issued on July 31st. I received a letter from the court yesterday saying that my claim would be deemed served as of the 5th August.

    It is now the 7th August, and the status of my claim online hasn't changed - it still just says "Issued 31/7/2007" Should this have changed to served by now?

    Also, under the judgement heading, there is a button labelled "start" - am I right in assuming that I shouldn't hit this button unless I hear nothing from capital One in 14 days after the claim is served?

    Crikey!!! not impressed by his customer service 'skills'. I'm sure he did just put the music on and not try ringing the other department.. I did know people who did that when I worked in a call centre ... I personally don't see the point.. might as well use the time trying anyway! :o

    Did you record the call, you could email it with an official complaint!
    Did you try ringing again.. I know.. .I never do as I think I'm going to get the same response but there should be several agents if not up to 25/30 different people in that department. But it might be worth trying one more time - and record it too - on a mobile phone once the call connects you press 'more' and at the bottom of the list it says record.

    Hope someone can advise...

    Started claim with Cap1 for £174+ £66 interest. They refunded £66 goodwill straight to closed a/c to pay against balance they say is outstanding. Problem is that NCO collected the debt for them in 2005 and I paid 50% of the balance outstanding in FULL & FINAL SETTLEMENT. Cap I say they have closed the a/c and are not chasing the balance they say is outstanding, but my credit report says "partial settlement" and still shows default. I have spoken to NCO who say I don't owe anything, and Cap1 who told me to ring a number that would help and turned out to be Debitas Legal Services. Spoke to Mr Coleman there. Explained everything and he said I had a very valid point and there shouldn't be a balance if NCO collected in Full & Final settlement. He agreed that anything I reclaim from Cap1 should be sent by chq to me and that my credit report should say "settled". He said to keep at them. My question is, is it worth paying the £30 mcol fee and taking the court route if Cap1 are only going to refund against the balance they say is on the a/c? Even if I get all charges back I would still have a balance according to Cap1. I don't agree and have told them so. I have asked for a chq direct to me but have had no reply. I should now go to mcol but if its going to cost me £30 and I have nothing to show for it at the end, I'm not sure if theres any point.
    Any ideas?:confused:
    Should I pursue my money and am I right to expect a chq direct to me? If I knew that they couldn't refund against this so-called balance, I wouldn't hesitate. I expected "full and final settlement" to mean just that!
