    Hi all, I just wanted to check I was doing the right thing with my MCOL claim against Capital One. I sterted my claim on the 30th July, and it showed up online as issued on July 31st. I received a letter from the court yesterday saying that my claim would be deemed served as of the 5th August.

    It is now the 7th August, and the status of my claim online hasn't changed - it still just says "Issued 31/7/2007" Should this have changed to served by now?

    Also, under the judgement heading, there is a button labelled "start" - am I right in assuming that I shouldn't hit this button unless I hear nothing from capital One in 14 days after the claim is served?

    MCOL will continue to say Issued I think even when it has been served. It will change if/when they acknowledge (yep...it will say "acknowledged"). Dont touch the start judgement button yet. You have to wait till their times up. Good luck, hope this helps:D

    The Court will send a copy of when they deem it 'served' usually a few days after 'issued' You will not get it for some time as they are so busy. The info will not 'change ' until some further action eg acknowledged
    After 14 WORKING days ,I think,from date served you will be able touch ' judgement'

    Did you record the call, you could email it with an official complaint!
    Did you try ringing again.. I know.. .I never do as I think I'm going to get the same response but there should be several agents if not up to 25/30 different people in that department. But it might be worth trying one more time - and record it too - on a mobile phone once the call connects you press 'more' and at the bottom of the list it says record.

    Neither was I -impressed -that is. This is the second timre that I have rung and got this response and so understanably I am reluctant to try a 3rd time
    What email address ? I had wondered about trying a web search.
    However I am only ,now, a few days away from a warrant and /or bailiffs

    I can't do it in rhymes, but I would suggest MCOL as you then get all the charges plus interest back.

    NO NO NO. It's not working days, it's calendar days. When it says days it means calendar days!!!

    JUST READ THAT A PERSON WENT TO COURT AGAINST A CREDIT CARD COMPANY AND IT WAS STAYED UNTILL AFER THE CREDIT CARD....I HOPE THIS IS NOT GOING TO BE THE NORM..........NOT HAPPY.........:mad:

    Just to say I'm new to this site, so I'll be no doubt asking advise here! Only sent my letter off yesterday to Cap 1 to ask for statements. The card was paid off & went to CCJ about 2 yrs ago, so about 4 yrs worth to claim, so here goes!!

    HSBC Claimed £9922 - went to FO, Bank offered £9922, waiting for the money to go into bank!
    Cap 1 Asked for statements
    Barclaycard Asked for statements
    HFC loan
    Self Combust Society Member :eek: :rotfl:
