I rang the Cap one number and was told that I could not be put through to that dept (claims)as they did not have telephone links and were not allowed to speak to public by phone. I must post etc. Frustrated as 21 days is up and also have been given judgement by default by MCOl but all gone very quiet from Cap 1
hi ripski when i phoned i just asked the guy on the other end of the phone , he didnt even mention that there was another department dealing wiv claims , sorry i cant help u any further as i dont know wot happens to u now cos ours was different to yours, but i do hope u get sorted soon, and get ur money back like most pple have jill0 -

I rang 08458400400 - which was on top of the letter offering half the amount.
I think it's just the normal customer service line and the guy put me through to a different department (he didn't say the name of it!) and the next guy said the check was in the post!
I started mycol on the 13/07/07 and was acknowledged or defended on the 23/7/07 - this is the easiest claim for me so far.
Nationwide mycol stage finished two months ago and still no court date:mad: and RBS credit card have offered people money in 7/8 weeks after the 2nd letter but not me! I will have to start mycol tonight for them.
Credit cards are different to the bank test case apparently. Monument Credit card are awful but I have to wait until sept for the court bit!
Try ringing again... remember call centres have hundreds of people in them and some of them are unhelpful because they are not too bright but there are some decent ones - I know I used to work in one (never again!).
Also, try asking for a manager to talk to - or team leader - they are more helpful and have more knowledge - you might of got someone new or just plain stupid!
good luck and don't give up. (also I didn't get a letter - I've heard nothing since the mycol start - I only found out because of ringing (Jill told me to) and postal strikes are slowing things down!

Can anyone advise me if they have claimed from Crap1 through the FO? My husband got a letter from Fo today saying, usual crap about OFT ruling saying £12 was fair charge blah, blah, blah. Then it says: As you and your credit car company disagree it is necessary for us to look into the complaint further. So that we can continue our investigation, we have today written to the credit card company to ask whether it wishes to increase its offer and if it does not for it to provide information about the level of charges applied and how they were calculated. If your complaint relates to other issues we may also seek additional information from it.
We shall write in one month to let you know that stage matters have reached. If you do not wish to pursue the matter further with us (should you prefer to take legal action) then please let us know as soon as possible and no later that 16 August 2007.
Is this a standard letter? What is their normal response and how do Crap1 usually react? How long does this take?

received a letter today in response to threatn court action. It is basically sayn what they are doing is fine and that they are defending their actions. Looks like it time to file the court papers:eek:0

Yep... got the same letter... sent them LBA then started Mycol and didn't hear anything for awhile but apparently cheque was posted yesterday for the full amount! this one was the easiest & quickest to claim from.

Im In Scotland and have to file a claim through small claims court, all the info is complicated has anyone from Scotland got any advice about how to go about the claim
Not sure if the claim should be in Scotland tho. I live there but their head office England. Please help amount <£400

Can't really afford the court route at the moment. If the FO can't get agood offer from them then I will have time to save for the court fees. I am pressuming that the FO mean that if they have written to them and they do not offer then they will be investigated, which I believe is a £400 charge!0

I don't think the FO are taking any more bank charge claims now until they have the result from the test case - better check that though - could try ringing them or re-read martins note on the main part of this site.
If you can't afford the claim now - can you afford when you get paid... I've done that with RBS CC as I didn't have the money - got paid Tuesday so I will start that one tonight - my court cost is only £30 so it's not too bad.
If you on a low wage or not working I think that you don't have to pay the court fee. check the main part of this site - it does mention it.

Whoops just checked mine and I issued it as cap one were the claimants and defendants ....so it was suspended and I have to do it all again ...and contact the mcol to get a refund...Im not really mad...0
