  • Hi I claimed for all fees Crap 1 had charged, recieved a rubbish offer of £226 when claiming £816. I rejected went through the MCOl process & Crap1 gave in agreeing to pay full amount.

    Well Ive gone for it!!! I put a claim in for the whole amount on Moneyclaim lets hope I havent blown it !!!!

    I have a Capital One account which has been passed to Cabots debt collection agency which I have a monthly repayment plan in place.

    I have claimed my charges back from Cap 1 via MYCOL and have received a letter from Cap1 saying they are going to pay the lot (charges/interest/court cost) back, but send it to Cabot.

    I just wonder if there is a away round this? I have spoken to Cap 1 and they say that I have to speak to Cabots. My main beef is that I have paid the court cost out of my own pocket and although Cap 1 are refunding this, they are sending it to Cabots.

    I ideally wanted Cap 1 to send me the cheque and I could then decide who/where I wanted to send the money to.

    Has anyone had any similar dealings or if they managed to get the cheque sent to them, how they managed to do it?

    Any advice would be appreciated. Thanks.

    I started my claim through FO around 20th June it was acknowledged by letter from FO. They have just said we will contact you in a month or so to update you whilst Crap1 can inform us whether they wish to increase their offer or alternatively provide additional information. However, should you wish to cancel you must do so by the 16th August. Wonder why I have been given a date? How long now????????????????????

    I think you will find Screwtop. like all other banks that the cheque goes to the bank/cc company. They will insist on this as they clear the balance then you will get any remainder. Had the same problem with Halifax.

    Ok all here goes...

    For those of you that are claiming your late fees and/or over limit charges back from Crap 1, to ensure you get all your cash back plus interest you must file with MCOL.

    This is the best way forward, I appreciate that a few people have already gone via the FO as you don't have to cough up any dosh but to be honest the FO just drag their feet now. From what I have read so far throughout the whole of this thread, yes thats page 1 to 71, is that anyone who has filed with MCOL has got their cash back, plus interest & court fees. Granted not everyone has or can afford the MCOL fee but if possible, beg, borrow or er yes the other that I cant condone :D

    Here is a little breakdown of procedures, dates may vary but not by much:

    1. You request statements, you usually get them within a week
    2. You send letter asking for fees, they make a poor offer in about a week
    3. You send letter saying I want the lot, they say no thats it about a week
    4. As soon as you get the above, you file with MCOL, it is served
    5. They have 5 days from being 'Served' to 'Acknowledge' claim
    6. They 'Acknowledge' your claim, you wait 28 days from 'Served' date

    This is where it can vary:

    7.
    i - They enter defence just before 28 days are up but send letter offering full amount around about same time
    ii - They dont do anything & you enter judgement, give it a couple of days then chase it up! (Im not 100% on the 'Judgement' bit but Im sure I will be.

    Either way you get your cash! ;)

    I sent my initial request for statements on 8th June (step 1) it was 17 July by the time I got to Step 3, I then waited 10 days as I didnt have a spare £120 for the MCOL, I filed MCOL on 27th July, they acknowledged & I am now waiting for the 28 days to expire.

    You may think how can i be so confident, simple, I read what other posters have said! :rotfl: :rotfl: :rotfl:

    Finally, those of you who have accepted part payment etc dont worry just file your MCOL for the full amount & they will deduct what they have already given you from your total. Let them do the math!! Whats the worst that can happen, they take the x amount you already had, it wouldnt get thrown out or anything they would just say, oi you had that few bob already so we work it out you're owed blah!

    Those of you who have had your accounts passed to Debt Recovery Firms will need to pay the DRF fully before you get any remaining cash but just think, even if every bit of the cash goes to clearing a debt, its one less you have to pay & what you would normally be paying monthly now goes in your pocket!

  • Can appreciate what you are saying but some of us unfortunately don't have the choice.............MCOL is fine if you are in England,but small claims only go up to £750 in Scotland (not sure in Ireland) so if your claim is more than that then FO is really best answer.
    Mind you at this stage I had got further with my last bank claim than this one with FO - a month in and it is still waiting to be looked at and last time I nearly had an offer!
