    hi, i have just recieved letter
    back from mcol stating that crap one is going to defend the claim. please can some one tell me what happens next? should i worry or just let it take its course. it was acknowlaged on the 6th of aug.

    please some one help or put me at ease

    give it a week and you will have a letter saying a cheque on it's way in another two weeks! Capital one are easy! took a few weeks in total - wish the same could be said for my other claims (going since feb!)
    I havn't heard of one single case where someone hasn't got the same result!
    Light bulb moment April 07: [strike]£3,655 [/strike] Oct 07: [strike]£2,220[/strike] now 0 - 3 years of Uni debt to be added at a later date :o:D
    now at Uni as a Mature student -update: now has a First Class BA!

    Im sending my DPA letter off tomorrow for sure.

    What happens if they dont make an offer, and defend the case all the way with MCOL? Do i have to go to court?

    I put in a claim for the full amount, as CAP 1 had no right putting money in the account, and could easily have taken it back.

    They backed down, and wrote to court saying they had already paid some, and would refund the rest, which they did. :D

    So don't worry.

    Their defence will be that they have paid you, and the money and a letter to you will follow suit.

    With some banks using the test case as an excuse with credit cards, nothing is guaranteed any more. But so far, CAP One have always paid in full, shortly after stating they will defend. Keep an eye out for the postman.

    mine was very near that amount. the fee for Mycol was £30 which you will get back.

    about a week after they defended - soon after starting mycol I got a letter saying they will send a cheque in two weeks... got my cheque today! yah... in bank in the morning.
    The total for mine was £278 which includes interest & court cost!
    don't worry you will get your cheque soon! This one is soooo easy!
