Thanks Dave. However at the time could not afford the court fees, so chose the FO route. This is dragging on and they have just written saying they have not heard from Crap1 and will update me in another month as they have had to chase them up. This is my hubbys account - but will start mcol this week for my charges. Do they pay up with interest or not?
  • sorry please excuse my stupidity - whats MCOL?

am in similar position to OP so would be helpful to know :)

    Thanks

It stands for Moneyclaim online and there is a link for it on the bank charges home page.
Unfortunately I had to go via the FO aswell because of the claims limit in Scotland and like k1mmie it's taking ages.

By the way, they sent the info to me without paying the £10, so I would try initially with not sending the £10

Well they def cashed my cheque and that's the last I've heard from them...........

further to my letter to Cap 1 dated 26th July

the builders from the empty house up the road have just delivered a letter that was sent from Cap 1 dated 31 July basically saying that they are sorry to hear that their offer is not aceptable to me & that I am considering court action but that their offer is a final offer & they won't be increasing it

due to family illness I've had other things to worry about but am I too late to take this further?

I've just noticed too that on my statements (I never usually check my statement in detail, just the payment received and payment due bits), that I'm paying Payment Protection Insurance every month I can't remember signing up for this but as it's on my statements & as I was made redundant last August (2006) surely I could have claimed on this, does anyone have any advice on this please

hi, i dont think its to late at all i got a good will of cap 1 0f £434, i send it back saying i would accept this as part payment , but basically thats all they were going to pay so u have to do mcol or go to the fo , court is quicker,i think , ive just sent my letter away for payment protection wot i never asked for even but if u go on the ppi site u will find cap 1 have been fined for selling ppi , will keep i informed about the ppi but i would just log ur mcol for ur charges gud luck jill
