I had my statements from Capital One and worked out the total with interest and sent off asking for it back.
Ive just discovered i havent got a copy of the 'interest' worked out that i sent to them. I cannot make another one as the interest wil be slightly different, its been 3 days.
When i file with mcol do i have to send them these documents? or isnt it a problem?

You don't have to provide it. Just put in your particulars of claim, that you have supplied the defendand with a list of all charges and interest. It will be needed if you go to court, but Cap one usually pay out, if you don't get a loony judge staying your claim.0

Should have come to this thread first i guess, but have just left a post on Barclaycard thread mainly to answer claire, but i hope it helps/gives a bit of confidence to others on here......
I won my case against CAP 1.:j Full amount details on BARCLAYCARD thread.
Main points are:
Done m-col,
They anckowledged,
They put up a defence (at least on the moneyclaim site it said that!)
Recieved a letter before next stage PAYING me in FULL.
Approx 16-20 days from point of m-col "served" to cheque through the door.
KEEP FIGHTING EVERYONE.

:j JUST LETTING YOU ALL KNOW THAT I HAVE RECEIVED LETTER FROM CRAP ONE TODAY OFFERING ME THE FULL AMOUNT AFTER FILING MCOL ON 6TH SEPBEMBER. THEY ACKNOWLEDGED ON 11TH AND LETTER RECEIVED TODAY.
SO THEY ARE STILL PAYING OUT TROOP

ok guys - update, finally! Crap one claim through the FO since July. Called yesterday only to be told they had offered the FO £862 on a claim for £950. We were told they were not prepared to repay the £12 charges since October last year. Thought this was not a bad offer and may take it. Then got a call from Crap1, asking why we had not accepted their offer as it was put to the FO 2 months ago. Told them they were lying as we spoke to the FO 10 days ago and they had no offer. Woman got really shirty and started raising her voice saying we were holding it up by not accepting and returning it. Feel like just taking them to court now and getting the lot plus interest- would this go against us as they have made a reasonable offer?0

it sounds like they are getting annoyed cos they want you to give up! start mycol now! I don't think they want a list of people waiting for the test case so they are testing you to see if they can give lower amounts!
see Claire's post above... so they are still paying the full amount after the mycol stage! so I would start ASAP (just in case they change their mind).
Pinkcat: they will defend the court bit but send a letter out soon after saying waste of court time ect but will send cheque within two weeks... so not long to go!
