    Wait until you get your cheque, bank it and cancel m-col ONCE it clears...

    You get a month to cancel m-col once they write to say they are paying you in full.

    Hi,

    I'm knew to this and I'm not entirely sure that I'm even posting this in the right place. I've notcied people talking about Cap One but earlier on in the forum so not sure if I'm doing the right thing but I shall carry on anyway with the hope someone can help.

    A couple of years ago I got a cap one card with a limit of £200. I am now currently over my limit, the balance is £432. Although I have been paying my mimimum amount every month since I had the card. The overlimit charges and interest have just increased the card to probable £200 over the limit when I was probably only about £30 over my limit initially.

    Anyway, I'd been looking at blogs on bank charges because when I was a student I was very silly with an HSBC account. I currently still owe them £1900 which has been passed on and on from one recovery to the next. I don't know the history exactly but at present Lowell Financial Ltd keep trying to contact me. I saw various templates for letters and although I have done nothing about the HSBC problem I thought I'd give cap one a go.

    I wrote a letter only yesterday regarding the overlimit charges and interest charges, asking if they could freeze them because my mimimum payment doesn't even cover my outgoing monthly charge.

    Should I have written about these charges initially? These charges have been going on for at least 18 months.

    Also any advice about the HSBC, now Lowell Financial Ltd. I know I occured loads of charges with that account too and it was quite a while ago but not entirely sure when. I have mailed Lowell Financial Ltd twice trying to sort this out but had no response.

    I'd be so grateful of any help or advice.

    Firstly, get the statements from Crap1 and work them out and get that claim started as this is not affected by the OFT test case. You can even email them and ask for this info - they will then let you know if there is a charge. (don't think I had to pay anything).

    With the HSBC, as this has been passed on to Lowell Financial, you should look up for the template for a CCA letter. (CAG site has one if you don't find it on here). This letter asks the company to provide all the information the owner of the debt has in their possession. (If Lowell have purchased the debt, they will hold this info), if not they will ask HSBC for it. This info will show you a copy of any signed agreement that you made. (If this info is not produced - they may not have it or be able ot produce at - then they cannot enforce the debt and Lowell will inform you they are no longer dealing with it and drop it like that!

    If on the other hand they can produce the details, then you need to take the same approach as with Crap1. Ask for all the statements and work out what charges have been incurred and at least log your claim. Even though the court is not taking on new cases you will be in the system of complaining with the bank and this may give you some time. Good luck. PM me if you need any help.

    Hi guys, have done MCOL for Cap1 today. So keeping fingers crossed it goes as smoothly and quickly as some others on here. Over 1000.00 claimed plus court costs. If the court puts a stay on my case then i will kick !!!. The stays are for bank charges not credit card charges. Good luck everyone else. xxxxxxxx
