Send your standard claim letter, but ensure that the first line says in bold capital letters that you are claiming under the hardship rule. If not, they look at the first line, and send the standard reply. If you have already claimed and been put on hold until the test case, you need to do it again, pointing out the hardship case.
On the envelope, put name of bank and address, and somewhere on the envelope "hardship rule"
If they do not acknowledge the hardship part, write saying you are reporting them to the FOS/OFT and FSA for breach of the waiver.
They have 8 weeks to sort it, or you can claim through the FOS. Again make it clear on the FOS forms and envelope , that you are an hardship case, and in the additional notes bit, state why you think you are, ie debt and benefits.0 -
Has anyone had success of getting all their charges back from Cap 1 without going through MCOL either with FO or any other way ie county court etc?0

It should be deemed served within the next couple of days, they will acknowledge about a week later so next friday ish...keep checking the mcol site
After this stage I got my offer of the full amount on 14th day. still waiting for my check though

I found the whole process with Capital One pretty painless to be fair to them.
I would encourage anyone who is thinking "can't be bothered or too much hassle" to go ahead with their claim.....and as early as possible....Just incase they decide enough is enough and start to become more awkward.

The 2nd easiest that i have dealt with (Natwest being easiest).
I even got a credit limit increase, a few weeks later.0 -

How long have you been waiting for your cheque now? They just don't get any better do they crappy one ... obviously bad losers! haha!0 -
Crap1 finally offered through FO. £862 on a claim of £950. FO said that you can still claim charges from after date they started investigating. However Crap1 were not prepared to repay any £12 charges since October last year, so may have to MCOL for that small amount.0

Got our letter from Crap1 through the FO and have signed and accepted. It was not far of the amount requested and do not have court fee money - so next best thing. Lets hope its not too long now.0
