MCOL says they have 14 days from the date they recieve the claim to defend it.
How do i know when they recieved the claim? Is the today? the day it was issued and accepted?

    Cheers

    hi hughie,

if you log back onto the MCOL website, its 28 days from their acknowledgement date I believe :)

(if you click on the bit saying acknowledged then a date it says 28 days ... not 14)

It only says issued at the moment, not acknowledged.

Does any one have POC that is specific to capital one:confused:
I have found POCs specific to individual banks and credit cards on this and other forums, but none that are specific to capital one and am wanting to file at Croydon County court tomorrow as I'm going to Croydon tomorrow

  • Well, after waiting for a month of eating potatoes and beans because my student grant was delayed i have finally bit the bullet and applied for my Capital one charges back through MCOL. I am hoping the 70 quid i have just forked out for the claim is a winner as it is money i could REALLY do with now. Still, if i win, i get my 1139.82 back!!!!!

    Fingers crossed folks. xxx

Thank you for giving me the courage to pursue it and i will keep you updated!!!

Ive never known them not pay yet, so fingers crossed for you. Your main enemy is the courts, who keep mistaking credit card claims for bank claims.

But the odds are way in your favour on this one.

p.s i thought ALL students ate potato with beans anyway, because thats all they can cook. :rotfl:

Cap 1 has until 22 Oct to respond after I filed my claim at my local court. Hopefully it will be resolved soon and I will post here once it is.
  • I wonder if anyone can help me?

I'm currently working through my MCOL for Cap One which is all a bit scary. I haven't written to them direct regarding these charges.

Firstly is the correct address for Cap One:-

    Capital One Bank (Europe) plc
    PO Box 5283
    Nottingham
    NG2 3WT

and secondly where it asks the question:-

    <TABLE cellSpacing=0 cellPadding=0 border=0><TBODY><TR vAlign=top><TD><TABLE cellSpacing=0 cellPadding=0 border=0><TBODY><TR vAlign=top><TD>Does or will your claim include any issues under the Human Rights Act 1998?
    </TD></TR></TBODY></TABLE>
    </TD></TR></TBODY></TABLE>
Do I answer yes or no?

Also, in the little statement box, I'm new to all this and I'm not entirely sure if I am supposed to state that I am claiming unlawful fees charged due to some kind of act??

    I've currently written:_

I am claiming for charges that I have
incurred on various occasions dating back
to February 2005 up until present date
    which is October 2007.
The amount of charges has accumulated to
    £328.00 to date.

I'd be so grateful if anyone could help me.
