I just rcieved a letter from the courts, saying Cap1 have acknowledged the claim.
On the claim form that they attached, it shows CapitalOne have ticked the box that says 'I intend to defend all of this claim'. Is this just acknowledging the claim?0 -

That is just an acknowledgement.
There defence, which will follow, will be that they have paid you.
Then a cheque or credit on your account will appear.
Thats if all goes to plan of course.0 -

Cap 1 had until the 22<SUP>nd</SUP> Oct to respond and have not. So I spoke to the court today and I will be dropping in my completed paperwork, requesting judgment by default, in the morning. Of course they could still get a defence in, however I think I am beginning to see some light at the end of the tunnel.0

I have run up a deb,t of 6K with a sainsbury's credit card, due to a hell of a lot of interest, they charge me £90 a month interest on this, so it never seems to go down, I am now out of work and and finding it very hard just to find the minimum payment, do you thinks its worth trying to claim back all this interest and not to mention all the other charges.

Charges yes, but you can't claim interest back.0 -
Has anyone had luck with taking Cap 1 to court but not using mcol (ie in Scotland) - do you think the process/time scales etc would be the same?0

I didn’t use mcol. I went to my local court and filed the papers there. Took about a week for the papers to be served but cap 1 should have acknowledged by 22<SUP>nd</SUP> oct and haven’t so I’ve requested judgement in my favour. I’ll post updates here as and when I get them.0 -
Hi all, this is my first post and the first time ive been onto this website so if i ask questions that have already been answered I apologise.
I have had my cap one card for 3 years and in September wrote to them claiming back my charges. These totalled £460. They wrote to me yesterday saying that they thought the charges were lawful and offered me the difference between the £20 they were charging and the £12 OFT limit.
They offered me £114 and another £10 on top for interest.
Should I accept this or carry on? Also if I do carry on, can someone point me to the next letter I need to send please?

Carry on, I got that letter, write back to them to say you dont accept this offer and want the full amount or you will take them to court, with interest. Go to the home page on here and all the templates are there. Cap One seem to be one of the easiest to get money back from so keep on plugging away. Good luck.0
