    Just spoke to the FO who said that credit card reclaims are still being dealt with. However, whether they come back and say accept the £12 is still to be seen, however I have heard that they are still saying that you can claim the full amount still. Keep you updated - awaiting my next letter in a couple of weeks.

    In light of the recent OFT/Bank announcement is it worth persueing my claim for charges against Capital One Bank??
    Lloyds tsb. Won 913pounds
    Capital One Bank . Won 806.18 pounds.(awaiting cheque)

    This case should not affect credit cards.

    Capital One always back down after an MCOL claim is submitted. But they may change, and try and use this case.

    The OFT are still handling cases too, but may only recover the difference between £12 and the charge. But if you write to Capital One, they will pay you this anyway.

    If you havent wrote to them yet, do it now, and keep an eye on other cases on the Consumer Action Group website, to see if they are still paying out.

    Thanks for that, only just sent out first letter with breakdown of charges. Having looked back on the statements they sent me i just realised that a couple had been refunded, guess i have to readjust the charges and interest breakdown?

    I left mine, after noticing the same had happened.

    I would wait for your reply, then, if you dont accept the offer, send a new list with your response. Its important that you get it right before court, but see what they say first.

    hi there first time on here.
    i have gone through the letter stages with cap one.been told they will only offer me a small amout of what they charged me (£12 charges) i have just filled the online court form.....what do i do now? do i have to wait untill the test case or can the credit cards still go through the system? help is needed.

    I have already been offerd a sum by Capital One (difference between my claim and what would be when £12 charged). I have rejected this, stating that it is not a true cost. Will they offer me more, or do you think I should accept what they have to offer. I am due to send court papers next week.
    Halifax Bank - £8,724.57 (inc int)- MCOL - settled £7,108.00 (claim less interest):j
    Halifax Credit Card - £279.70(inc int) 1st request :rolleyes:
    Egg - £665.26 (inc int) - MCOL £749.97, by default :j
    Marbles - £1,390.54 (inc int), offered £0. 2nd offer £550, threated court for remainder, accepted £1096 (claim less interest) :j
    Capital One - £1,024.72(inc int), MCOL settled £1,152.77, (int+court costs) :j
    Creation - £375.55 - 1st request, settled £312.41 :j
    Barclaycard - £1343.27 - offered £366 - rejected threaten to court :mad:
    Sainsbury Bank - £ £1056.86(inc int) - MCOL :mad:

    Until now, Capital one have always backed down 3 weeks after you file with MCOL, refunding all charges, interest and costs. I know of over a dozen cases, including my own, and another case i handled.

    Yesterdays news was for current accounts only, so i assume this will still be the case. But keep an eye out for cases still being won, over the next few days.

    Well it didn't take long for the 'threats' to begin.
    The OH received a phone call tonight from Cap.1 saying if he didn't accept the (measley) offer made to him then he would get nothing due to this test case going ahead.
    Just aswell we know that it doesn't apply to credit cards and this was obviously just a scare tactic - we informed him to get his facts right! ;)

    I've got someone on this thread who say this is separate from the bank test case.. credit cards are different (?????) I would like this to be true but I'm having difficulty believing this!
