I have had the same letter as you, I claimed 300,they offered 170.
There is a template letter on the cag website which excepts there offer of ......... in part payment and that you will proceede with court action. Also on this letter it says that you want the default notice removed (if this applies to you)
The next step then is either the fo or court. Im going for the court route, but im not sure where i stand with the default notice.
I will let you know how I get on, and if i can find any one that has had a default removed. Good luck with yours and keep us posted

I got a letter from cap one saying they are paying me in full :T .
within fourteen days question is does it take full 14 days to get cheque as going on me hols on mon for three weeks and need to send back form to court not sure if i should send it till i have cheque but the form has to be back by 21st aug and im not due home till then so what should i do. if you have won with cap one please pm me to let me know how long you waited for cheque Thanks good luck everyone :beer:0 -

I have received a letter offering £180.00 which I have declined and sent the LBA, I have now received a second letter stating that they will offer £180.00 only and no further offer would be made, do you think I should accept thisor follow the MCOL route?0

I see from the general comments on here that Cap One pay up 21 days roughly after MCOL is started. Do they pay up the interest or just the charges? Be interesting to know as I started mine today

trying to get my charges back from capitalone, pain in the a**e. Had to go the onbudsman (spelt wrong i know couldnt find spell check) so still waiting.

hi all.
ok had a bit of success with capital one.i wrote asking for all my statements.i took 1 week for those to come yep very quick.i went through them and amounted up £440 in charges mainly just over limit fees.i sent them a letter claiming this back .received a letter just 9 days latter stating.thank you for taking time to write to us blah blah blah.as a matter of goodwill id like to reduce your fees to £12 each.i`ve refunded £136 plus £10 as an acknowledgment of interest that you have incurred to your account.....
ok not £440 but its a start and they were very quick about.
about to send 2nd letter as im not accepting this small amount.
if i were to get the full amount back then that would clear my account as i owe £390.if that would happen then i would then get ride of the damn thing and close the account.....0 -
Hi Fred , I have had the final offer letter sent also and no further offer will be sent letter. In my rejection letter I told them that I was taking action after the 14 day period and they said they were dissapointed to hear that now can I go back to them using the without predjudice letter or is it best to go strait to the FO or Mcol .. ?

We are at the same stage and as i see it, they have made their final offer and they probably wont reply to another letter from you or me. So on the basis that we have both rejected, its time for fo or court.
Im going down the court route as i now want the interset too. Not being greedy but stamps are not cheap and i also want a default notice removed.
So, its time to move on to final stage and sue them..(if they have registered a default against you ,make sure you ask for this to be removed in your court claim)
