Hope that there is no time limit to start MCOL , cos Im in hospital and it wont allow certain actions on the pcs in here ,I was going to call the FO for advice first but seeing as Im not the only one to get this letter I will wait till next week ... thanks

Hi everyone - 1st post in this thread. I have started MCOL with capital one, and it was acknowledge by them on the 11th July (£1600), I was just wondering if it is 21 days from this date they usually pay??? :rolleyes: :rolleyes: :rolleyes: I could do with the money for holidays!!!
Had my claim acknowledged on the 3rd July and received a letter dated 18th July saying they are settling in full . Still awaiting cheque though. Should be within 14 days . Hope this helps .0 -
Just printed my letter asking for £520 back, as Cap 1 is part of my DMP I am hoping that they treat me fairly. If I get the whole amount back then it will clear my current balance (£225) with a little left over.

I'm claiming £660.28 inc interest from Cap 1 & today have received a letter (also from Ellie Renshaw) stating they have repaid £208 back to my account (I've checked online & they have) being the difference between the higher amount chargd & the reduced fee of £12,they also quote in the the letter I signed the credit card agreement when opening my account agreeing to these fees. Reading some of the previous posts I see I can actually ask for the rest of my clain, I'm a little worried about taking court action but I don't want them to keep the money I feel is owed to me, I also read this letter http://forums.moneysavingexpert.com/...postcount=1123 & although I've no idea what Self Litigation means can I use this letter or does anyone suggest a different tact.0 -

I recently sent Capital 1 a letter asking for a statement of my charges which they sent me, and i totalled up that they owed me £480, so i sent them the 2nd letter saying that i want my money back, and they sent a reply saying that they arewilling to offer me £192 for my charges and £10 to cover any interest i may have incurred over the time, but i wasnt happy with that as its nowhere hear what they owed me, so i sent them a reply saying that i dont except their offer as it was nowhere near the amount that i had paid.
I got a reply from them today saying.....
"were confident our fees are both fair and legal. The OFT havent told us that were obliged to refund any fees, and were offered refunds as a gesture of goodwill.
My offer of £202 is still open to you. I wont be increasing this, as it is my final offer.
Blah blah...
Again, I look forward ro recieving a signed settlement form so we can put this behind us and save the courts valuable time"
Is there anything else i can do, i have i just got to except the offer of £202??

I've re-read the linked letter & for me that may be a little too strong .. at this point anyway so I think I'm going with another letter I've just come across

I am writing to inform you that I accept the money that you have refunded into my account as part payment without prejudice but that I intend to proceed with my claim for the full amount.
Alternatively, should you wish to settle my claim in full, then please forward the balance of the claim (enter amount) plus interest without further conditions
Please note that the amount refunded to my account as of todays date is (enter amount).

Your next step should be the court process or going through the ombudsman. This is just the standard reply that they give everyone so don't worry.0

Capital One acknowledged my claim and then the status changed to "defence" on the MCOL website.
Today I got a letter saying they are sending me a cheque for £752!!! This is the claim amount plus the court fee PLUS an extra £20 - brilliant!
It says in the letter that they are refunding £560.47 in addition to the £192 they refunded on 6th June. It then goes on to say that, as my account is closed, they will send a cheque for the full amount.
What strikes me as strange is how they "refunded" £192 when the account has been closed for 2 years?!
Anyway... nothing to worry about? Just wait for the cheque and then contact the court to cancel the claim?

Now I've got a £1.9k claim with NatWest (which they're defending) and £400 with Barclaycard (which I've just asked for).
