    Also, I was under the impression you could claim 8% interest on the charges as that is what the courts would offer anyway. Therefore asking for the interest on top before going you go to court seemed to be the right thing to do, could be wrong though!!

    Financial Ombudsman - its free - you just fill out a form online then print it out and post it to them. Once you have the letter from Crap1 saying that is their final offer you can go to the FO. Every complaint made to the FO costs the bank £400 should they not want to settle but be investigated. Lets face it - no bank wants to be investigated and at that cost per enquiry - they prefer to settle. Once the form is forwarded they write to you acknowledging your complaint and then you have to allow them around 8 weeks, but ususally hear from them before. They write to the bank asking them to either pay or be investigated. Good luck.

    :mad: i have recieved afull refund from capital one after 21 days of taking court action:beer: .anyway they havn,t removed my default:mad: sent them a letter stating that i have recieved monies but they havn.t removed my default they sent a reply the account defaulted as a result of your failure to pay? i havnt stopped court proceeding as yet as they have not given me a full settlement is this right or do have to stop court? as in my sar and lda states i want to remove this default? they said my default started 1/4/2002 this should be removed by next april:rolleyes:

    I've just checked mycol and it has the above message - does anyone know what it means... it's been like this for 3 days now! I got the first piece of paperwork from mycol for this claim so I'm hoping it's just the website?
    I couldn't get through on the telephone number for mycol so thought I'd see if anyone knew the answer on this site.

    Yes i am expierancing the same problem it rectified itself today though i dont understand i put my claim in against lloyds tsb on friday 13 i had all money available in the bank and it didnt take the money :confused:
    Anyway it seems to ok now.

  • hi guys just checked my mcol and i started it on the 6/7/07 strange cos my says defence then hubbys still says ackwnoledged , but on friday got 2 letters 1 for hubby and 1 for me saying we will get our charges back, hubbys went onto his account , so hes getting a cheque for £650 , wonder y mine says defence now when they say there going to send me a cheque for £1,150 when my account is closed , does any 1 know y cheers jill

    Mine still says acknowledged. Get the impression they send the letter saying they are paying up and at the same time tell the courts they are defending the claim on the grounds that they have paid! hubbys status shoulld change too.. think its justs a processing thing.. dont cancel your MCOLs until youve got the cheques and have them cleared in your bank!

    Capital One £1112 Request letter sent, 11/06/07 offer of 348 received, "ill have a part payment pls along with the rest" leter sent
    Black Horse £25 supposedly?! - i think not! show me evidence!
    Halifax lBA sent 20/06, Rejection letter 22/06, Phoned for Reevaluation 25/06 ..the waiting starts
