    Capital One acknowledged my claim and then the status changed to "defence" on the MCOL website.

    can I ask a question... It looks like they pay out after 21 days of starting the mycol stage.. .did you find this too?
    I started mine on the 13th July so hopefully I'll get a letter around the 3rd of August!
    I could do with a quick one as two others have been going since February and still waiting for court dates (one is the 6th september!)

    now at Uni as a Mature student -update: now has a First Class BA!

    Well I started the claim on the 5th July and this letter is dated 20th July, so even sooner for me. :beer:
  • Standard reply. Having issued proceedings against Barclays and referred Lloyds TSB to the ombudsman I would go for the latter option if I were you.

    Less hassle in my book, and you don't have to pay an issue fee up front.

    Sorry, but if the OP goes to the FO, then all he will most probably get back is the difference between the charges and the £12 the FO recommends now for credit card charges. And no interest. File a court claim and you will receive the full amount including interest and court fees. Cap 1 aren't that difficult to crack once the claim is filed, especially with such a low amount.

    Don't think this is strictly true - I'm sure somebody posted on the ombudsman thread that you can claim the whole amount (not sure on interest tho) through the FO as they don't just claim the difference for you back.

    So whats the easiest way to do this? Has anybody got a link that i can use to go the court route please? or should i just send them a letter threatening with court action 1st?

    give them two weeks to respond and then go to Money Claim Online.
    apparently they are paying up 21 days after the acknowledgement - I've just got my acknowledgement from the court dated 23rd July - so hopefully not to long I hope!

    I have had the same letter as you, I claimed 300,they offered 170.
    There is a template letter on the cag website which excepts there offer of ......... in part payment and that you will proceede with court action. Also on this letter it says that you want the default notice removed (if this applies to you)
    The next step then is either the fo or court. Im going for the court route, but im not sure where i stand with the default notice.
    I will let you know how I get on, and if i can find any one that has had a default removed. Good luck with yours and keep us posted

    my first post on here but I have been watching from afar with awe at how well you guys have been doing and I will now let you know how I have got on.

    I initially claimed £640 from Cap One, £900 from Barclaycard and £3600 from NatWest. Cap One and Barclaycard, like so many other people have stated, reduced all my charges from £20 to £12.

    I accepted both offers as partial payment (they both went onto my existing accounts) and pressed on. Barclaycard still havent replied to my next letter threatening MCOL, but Capital One replied saying they would not be paying out a penny more and I should go to the Ombudsman if I had any further grievance.

    I immediately commenced MCOL, and the £50 fee brought my total claim upto £440. Capital One acknowledged the claim then sent me a letter saying they did not admit any wrongdoing but they would pay the £440 in full, which meant putting my balance to £0.00 and sending me a cheque for the remainder within 14 days. The deadline for that was 26th July. I also received a letterf rom the court asking me if I wanted to drop my case. I did not reply, as I wanted to wait until I actually received my cheque before replying and droping my case.

    Today (26th July), a letter came with a cheque for £228. I am just off out to post the court return form, dropping the MCOL, and pay in my cheque. I will use the money to start my MCOL against Barclaycard...

    From starting MCOL to getting my cheque has taken approx 5 weeks.

    I hope this is a fillip to anyone that recognises the stages I have described. Good luck all.

    good luck, but you wont need it. If you start your MCCOL today, expect to see a cheque by the first week of September or so.
