  • Difficult one Leona. No costs involved by using the FO but you won't get any interest back by using them as it won't be reaching the court stage and it may well be slower.

    Has your brother sent off any letters as yet? No harm in starting the proceedure and seeing what happens then if they say an absolute "no, see you in court" you could pass it on to the FO.
  • I have just received a letter from the Advice Quality Unit - Leeds. It says it's regarding "reopening my complaint" - as far as I was aware it was never closed! They say they are looking into it, blah blah blah..........should I just continue to set up court proceedings, or give them a few more days?

    Why not give them a ring and see how long they reckon, if they then say the usual "we have 8 weeks" or similar start the court proceedings and tell them thats what you will be doing on Monday.

    The other thing is if they are telling you to deal with Leeds you could then claim under English law provided you are prepared to travel to court should it come to that. Have a read of this website, if I haven't already posted it for you.

    Barclays seem to be doing this in nearly every court claim. They go along with it right up until the hearing. They have not taken one single case into a hearing yet. They are hoping you will be scared off and drop the case. Whatever you do, do not give them extra time. You will be playing into their hands.

    Any contact you have outside of court will only let them know you are worried, and strengthen their resolve. Just keep on with the claim, your chances are excellent if you don't buckle.

    She doesn't need to take the court action but I would try the letter before action anyway as to be honest they are going to take more notice of that than a letter saying you are moving your account.

    I really love this thread - there seems a clear division of opinion.

    TBH I can't for the life of me understand why somebody would endorse the banks charging excessively high fees.

    The arguments seems that "if they don't charge these high fees then they will get this money from monthly fees."

    One point does not equate to the other. The proper response should be that "as the banks presently charge an excessive amount they should now change this and charge an amount that does not penalise me or makes a profit from me".

    Of course banks have a right to charge anybody for going over their agreed limit or asking for a charge for a standing order or a cheque not being honoured - but this should be to cover their actual costs etc. What we are asking the banks to do is to explain the breakdown of the charge as they are not allowed to penalise you or make profit out of a charge. IN short the charge should represent the actual cost to the bank.

    In all the successful claims for charges - the banks have NEVER offered to give a breakdown of the charge ... NEVER. Does that not seem strange????

    It is for ths reason alone that they would settle out of court then have to explain the charges.

    If banks now want to increase their profit streams from monthly fees as they are losing out on profits from bank charges- then that is more telling about the bank not about the people who have demanded an explanation to the breakdown of their charges.

    I sent off the first letter to ask for his statements (6 years worth), received a letter saying that it was now in the hands of this Leeds office and to contact them if i need help. They thanked us for the £10 fee and said they would send them within the 40day deadline. I think they have a week to go until that deadline is up.

    As soon as i get these statements i will send out the letter about the charges. I'm going to die when i see my brother's statements as he's hopeless with money. Ah well i just hope i can help him out and get him out a bit of a hole!!

    I am sending off my 2nd letter to clydesdale bank in leeds by rec del tomorrow.

    Thats the same letter I received about 10 days ago. Still no further response from them, so ill be sending another letter over the weekend telling them theyve got 7 days to reply or ill pass it to the courts.

    From reading a lot of the threads on this board it seems Clydesdale are one of the worst/hardest to get money out of. Not seen anyone posting after winning a decent amount yet.

    I see it this way, a bank is a bank whether it's Clydesdale or not and the law is the law. So if they've over charged (which they have) they will have to cough up like the others. They may put up more of a fight but I haven't heard of anyone lose yet either, maybe people give up before taking it a step further like going to court.

    So dig your heels in like me and win over the Clydesdale bank. I'm determined...for my brother's sake.

  • I don't have the phone number on my letter from Leeds - anyone got it? And has anyone else spoke to them? Are there any success stories with CB yet?

  • I have just spoken to someone in the Advice Quality Unit in Leeds - I eventually had to phone the head office in Glasgow - 0141 248 7070, and they then put me through to the Leeds office. It would appear that it's a tricky number to get a hold of!

    To cut a long story short he said it would take approx 7 - 10 days to get an answer, I then asked what the answer would be likely to be, after a wee bit of blah blah he said that the most that would be offered would be 50% of the charges (without interest) - but that's the most the offer would be - so it would appear unlikely to even be offered that. I asked why other banks were paying out much higher percentages - to which he had no real answer.

    I then informed him that I would indeed be starting court proceedings. He told me that they would continue their investigations, and get back to me whenever they had their answer. Hmmmmm!

    Will be starting the court stuff on Monday. :-)

    Sounds more promising though as no-one has posted yet about any success with the Clydesdale bank. I hope you get your money too as I am coming along behind you.
    Saving in my terramundi pot £2, £1 and 50p just for me! :j
