    I think it's a good sign that they've opened up a new Department in Leeds to deal with these claims, it's a sure sign that more and more people are claiming now. Obviously they will get to the stage where they'll just pay out as it will cost the Bank more money in the long run with Court fees and Solicitors to pay etc. Time will tell.....

  • Hi, This is my first posting
    I recently sent my letter requesting the data subject access request to the Clydesdale Bank for two separate accounts (sent two seperate letters) on Feb 8th.
    On the 12th Feb, noticed the Clydesdale had cashed my two £10 cheques which I had enclosed with my letters (nothing new there then! :mad: ) and on the 15th Feb recieved two very polite replies stating that they would be able to supply statement copies for both accounts within 40 days.
    So far so good, first stage complete........noticed from previous postings and as I live in Scotland that this will be more challenging than my counterparts South of the boarder.
    I think (only guessing at this stage) that my accounts will total more than £750 worth of charges each over the entitled 5 years in Scotland.
    After the second stage and if my Bank refuses my demands, I would like help and clarification on the next stage? As living in Scotland and the small claims court limit of £750, can I split the claims?, say claiming one year at a time! or should I proceed with the 'Summary cause Court' (for claims of £1500+) whilst probably more complex, it would appear to be a better finacial gain. Also would I require a solicitor for a Summary Cause?
    If anyone has been successful with the Clydesdale Bank or indeed can let me know which route they have taken or advise me I would be most grateful.

    PS The Bank letter requested that I should contact the Leeds office should I have any queries, does this entitle me to claim via the English small claims court, or is this wishful thinking!
  • Just spoken to a friend of mine who, after reading these forums, decided to go ahead and try and reclaim back some of the bank charges he incurred over the last 6 years. His account was with Clydesdale, however due to poor service he closed this account and no longer remembers the sort code or account number. Having spoken to Clydesdale they have advised him that in order for them to check their computer system for his details (ie s/c and a/c number) they will charge him £40 an hour! Plus £5 for his statement! Surely this is only a five minute job that can be achieved by a teller in a branch? I have the feeling this is just another way of putting people off reclaiming charges. Any advice would be much appreciated.
  • Received the standard "NO" letter after claiming 6 x £25 charges to my wifes account,she set up an account with Yorkshire Building Society in case the Clydesdale closed the account as a result of any court action,after receiving the letter she does not want to take it any court action against them.I was thinking of writing back confirming that no court action was being taken against them but also advising them that her wages were no longer going to be paid into the Clydesdale account(she,s on a good wage) and attempt for a goodwill payment!.We could then leave a penny in the account and cost them money in statements posted out.

    after i sent my 2nd letter asking for my charges plus interest back, i've had a letter from the Clydesdale bank with a list of terms and conditions and saying that i am responsable for the running of my account and ensuring there are sufficiient funds in my account. They say the are not prepared to refund these charges and to refer it to the Financial ombudsman service if i wish to pursue this.

    NOT SURE WAT TO DO NOW!!!

  • Hi again im just going to send the 3rd letter demanding my charges back otherwise taking them to court, the letter asks me to input the court name, what should i put in, is it my local sheriffs court i say im getting.

    I have also had our complaint being reopened letter - it is dated 21st February and I had given them till 28th before I did anything else. They say they will write as soon as possible??? I dont think I will give them much longer than next week. Hopefully then I may get something out of it
    Saving in my terramundi pot £2, £1 and 50p just for me! :j
