I am on the verge of going to court - I have already threatened them with this and there has been no response. £579.50 plus interest - £699.01. I see there is now an english address for the CB - can I go through the english system and claim back the full 6 years plus interest, or will I have to stick with the scottish system and claim 5 years plus interest?
Help!

If you live in England you can go through MoneyClaim and claim back 6 years.

Live in Scotland - so must I claim through Sheriff Court for just 5 years?0

Basically yes unless you have an address in England you can use.

Would it be worth while claiming 2 lots of 3 years through court? As it stands in Scotland you can only claim up to 5. Just wondered if it was worth the hassle of 2 claims!
Thanks :-)0 -

I have just received a letter from the Advice Quality Unit - Leeds. It says it's regarding "reopening my complaint" - as far as I was aware it was never closed! They say they are looking into it, blah blah blah..........should I just continue to set up court proceedings, or give them a few more days?
Thanks0 -
I had the usual letter Yesterday re not getting the money back and terms and conditions etc so I have sent a second letter recorded delivery to-day and I have told them I will pass on to the ombudsman ( rather than the courts) if I have no settlement within 14 days as they may not limit it to £750.00 like the courts do. I thought I would try it anyway as I am in scotlandSaving in my terramundi pot £2, £1 and 50p just for me! :j0

Is there any costs involved with filing through the Ombudsman re bank charges? I remember using the Ombudsman when i was proceeding with my endownment mortgage and won. They were very helpful indeed.
I think i remember someone saying that you don't get offered as much money back in your claim. My brother has thousands of bank charges over 6 years so it will be a pretty long drawn case if we have to do this in batches of £750!
Just this month he got £75 in charges for just being £40 overdrawn! £25 per day.
